In Article 5 of Circular 01/2022/TT-BTP, there are regulations on the level of online civil status registration as follows:

1. The civil status registration agency receives and processes requests for online civil status registration in accordance with the level of implementation of online public services at localities in the country and representative agencies.

2. The list of civil status registration agencies that do not have the conditions to receive and process online civil status registration requests must be publicly announced on the National Public Service Portal, Electronic information portal of the Ministry of Justice, Electronic information portal on consular work of the Ministry of Foreign Affairs and Provincial one-shop electronic information portal.

What is implementation of submission, receipt, and return of online civil status registration results in Vietnam? 

In Article 6 of Circular 01/2022/TT-BTP, there are regulations on submission, receipt, and return of online civil status registration results as follows:

The submission, receipt, and processing of online civil status registration requests are carried out in accordance with the provisions of Article 12 of Decree No. 87/2020/ND-CP and the following instructions:

1. Photocopies of documents that must be sent with the online civil status registration application must ensure clarity, completeness, and integrity of content, and must be taken with a camera, phone, or taken or scanned with electronic devices, from valid and valid documents; has been consularly legalized and translated into Vietnamese according to regulations if the document is issued by a foreign competent authority, except in cases where consular legalization is exempted.

In case the requester does not provide complete copies of the necessary documents as prescribed or the copies sent with the online civil status registration dossier do not meet the requirements in this Clause, the civil registration agency shall notifies the person requesting additions and completion.

2. In case the papers and documents that must be attached to the online civil status registration application have electronic copies or electronic copies of civil status documents are available, the requester may use these electronic copies.

In case the requester has provided a personal identification number, he or she does not have to attach a photocopy of identification documents or proof of residence in the online civil status registration application. The civil status registration agency is responsible for exploiting and using information from the electronic civil status database and the national population database on the basis of the personal identification number provided by the requester.

3. After receiving the dossier on the system, the civil status officer is responsible for checking and comparing the information in the dossier and returning the electronic form with complete information to the requester by mail or digital devices. Within 01 working day, the requester is responsible for checking the accuracy and completeness of the information on the electronic form.

If the requester confirms that the information is consistent and complete or there is no response after the request deadline, the civil status officer will process the file.

4. The order and procedures for handling civil status registration after receiving online civil status registration documents are implemented in accordance with the provisions of the Civil Status Law, Decree No. 123/2015/ND-CP dated December 15. November 2015 of the Government detailing a number of articles and measures to implement the Civil Status Law, Article 12, Article 13 of Decree No. 87/2020/ND-CP and Circular No. 04/2020/TT-BTP dated May 28, 2020 of the Minister of Justice detailing the implementation of a number of articles of the Civil Status Law and Decree No. 123/2015/ND-CP (hereinafter referred to as Circular No. 04/2020/TT-BTP ).

5. The return of online civil status registration results is carried out according to the provisions of Clause 4 and 5, Article 12 of Decree No. 87/2020/ND-CP and the following instructions:

a) For civil status matters, the law requires that the person requesting civil status registration must be present at the civil status registration agency. When coming to receive the results according to the Appointment Form to return the results, the person requesting civil status registration Citizens must present identification documents to prove their identity; Submit or present documents that have been sent as copies in the online civil status registration application so that the civil status registration agency can keep the records or check and compare according to the civil status law, except for documents that have been submitted as copies (if any).

b) In case the person requesting civil status registration fails to provide the documents specified in Point a of this Clause or the submitted or presented documents are erased, modified or falsified, the competent civil status registration agency cancels civil status registration results.
