What is guidance on the Law on Emulation and Commendation of Vietnam in the Agriculture and Rural Development sector?
On November 15, 2023, the Minister of Agriculture and Rural Development issued Circular 10/2023/TT-BNNPTNT (effective from January 1, 2024) detailing the implementation of a number of articles of Law on Emulation and Commendation in Agriculture and Rural Development.
According to Circular 10/2023/TT-BNNPTNT details the following:
- Clause 4, Article 24 of the Law on Emulation and Commendation 2022;
- Clause 3, Article 26 of the Law on Emulation and Commendation 2022;
- Clause 3, Article 27 of the Law on Emulation and Commendation 2022;
- Clause 3, Article 28 of the Law on Emulation and Commendation 2022;
- Clause 2, Article 71 of the Law on Emulation and Commendation 2022;
- Clause 6, Article 74 of the Law on Emulation and Commendation 2022;
- Clause 2, Article 75 of the Law on Emulation and Commendation 2022.

What standards must a collective awarded with a Diploma of Merit from the Minister of Agriculture and Rural Development meet?
In Clause 2, Article 8, Circular 10/2023/TT-BNNPTNT (effective from January 1, 2024) stipulates emulation and commendation diplomas of the Minister of Agriculture and Rural Development as follows:
Diploma of Merit from the Minister of Agriculture and Rural Development
1. Diploma of Merit from the Minister of Agriculture and Rural Development to be awarded or posthumously awarded to individuals who meet one of the standards in Clauses 1 and 2, Article 74 of the Law on Emulation and Commendation.
2. Diplomas of Merit from the Minister of Agriculture and Rural Development are considered and awarded to collectives that meet one of the criteria in Clause 3, Clause 4, Clause 5, Article 74 of the Law on Emulation and Commendation.
3. Special cases are decided by the Minister of Agriculture and Rural Development.
Thus, the collective awarded the Diploma of Merit from the Minister of Agriculture and Rural Development must meet the following standards:
- An exemplary collective that well complies with the Party's guidelines, State policies and laws, maintains internal solidarity and meets one of the following standards:
+ Have excellent achievements reviewed in the emulation movement;
+ Achieve extraordinary outstanding achievements, with scope of influence in each field under the management of the Ministry, department, branch and province;
+ Contribute to socio-economic development, applying scientific and technical advances, social work, and humanitarian charity;
+ Have 02 consecutive years of being recognized for excellently completing tasks or achieving the title of "Excellent Labor Collective" or "Determined Victory Unit", good implementation of democracy at the grassroots, good organization of movements to compete; take care of the material and spiritual life of the group; practice thrift and combat waste; Prevent and combat corruption and negativity.
- Enterprises and other economic organizations well comply with the Party's guidelines, policies and laws of the State and meet one of the above standards or have achievements in contributing to the development of ministries, departments, branches, localities recognized by ministries, departments, branches and provinces.
- Exemplary households that well comply with the Party's guidelines, State policies and laws, and make many contributions in terms of effort, land and assets to the locality and society.
What are standards for a group to be awarded a Certificate of Merit from the head of an agency or unit under the Ministry of Agriculture and Rural Development?
In Article 9 of Circular 10/2023/TT-BNNPTNT (effective from January 1, 2024), regulations on emulation and commendation certificates of heads of agencies and units are as follows:
Certificate of Merit from the head of the agency or unit
1. Heads of agencies, organizations, and units with legal status under or under the Ministry of Agriculture and Rural Development shall decide to award Certificates of Merit to individuals under their management authority who meet one of the following criteria:
a) Complete the task well or better;
b) Have achievements that are reviewed in the emulation movement;
c) Achieve extraordinary outstanding achievements that contribute to the overall development of agencies, organizations and units.
2. Heads of agencies, organizations, and units with legal status under the Ministry of Agriculture and Rural Development shall decide to award Certificates of Merit to exemplary collectives that comply with the Party's guidelines, policies, and procedures and meets one of the following standards:
a) Complete the task well; internal solidarity, good implementation of democratic regulations at the grassroots, practicing thrift, combating waste and not having individuals violate discipline;
b) Have excellent achievements reviewed in the emulation movement;
c) Achieve extraordinary outstanding achievements that contribute to the overall development of agencies, organizations and units.
3. Heads of agencies, organizations, and units with legal status under the Ministry of Agriculture and Rural Development shall decide to award Certificates of Merit to exemplary households that well comply with the Party's policies and laws, contributing outstanding achievements in the fields directly managed by agencies, organizations and units.
Thus, the standards of a collective receiving a Certificate of Merit from the head of an agency or unit under the Ministry of Agriculture and Rural Development are:
- Complete the task well; internal solidarity, good implementation of democratic regulations at the grassroots, practicing thrift, combating waste and not having individuals violate discipline;
- Have excellent achievements reviewed in the emulation movement;
- Achieve extraordinary outstanding achievements contributing to the overall development of agencies, organizations and units.
