What is decision on establishment, dissolution, merger, division, adjustment of administrative boundaries of provinces and municipality-controlled cities at the National Assembly session in Vietnam?
In Article 48 of the National Assembly's Regulations promulgated together with Resolution 71/2022/QH15 (effective from March 15, 2023), there are regulations on decision on establishment, dissolution, merger, division, adjustment of administrative boundaries of provinces and municipality-controlled cities at the National Assembly session are as follows:
1. A dossier to be submitted to the National Assembly for decision on the establishment or abolition of an agency includes:
a) A report on the establishment or abolition of the agency;
b) The scheme on establishment and abolition of the agency;
c) A report on impact assessment of the establishment or abolition of the agency;
d) A report summarizing opinions of relevant agencies and organizations;
dd) Draft resolution on establishment or abolition of the agency;
e) Verification report on the establishment and abolition of the agency.
2. Dossier to submit to the National Assembly for decision on establishment, dissolution, merger, division and adjustment of administrative boundaries of provinces, centrally run cities, special administrative-economic units, including documents as prescribed of the Law on Organization of Local Government and the inspection report of the Law Committee of the National Assembly or the Provisional Committee on the establishment, dissolution, merger, division, adjustment of administrative boundaries of provinces and cities under central government, special administrative-economic units.
3. The National Assembly decides to establish or abolish ministries and ministerial-level agencies; establishment, dissolution, merger, division, adjustment of administrative boundaries of provinces, centrally run cities, special administrative-economic units in the following order:
a) The Government representative presents the report;
b) The representative of the National Assembly's Law Committee or the Interim Committee presents the verification report;
c) Before discussing at the plenary session of the National Assembly, the National Assembly deputies may discuss at the National Assembly Deputies Group;
d) During the discussion at the plenary session of the National Assembly, the Government explains the opinions of the National Assembly deputies on issues related to the establishment and abolition of ministries and ministerial-level agencies; the establishment, dissolution, merger, division and adjustment of administrative boundaries of provinces and centrally run cities, special administrative-economic units;
dd) The National Assembly Standing Committee directs and organizes the study, explanation, reception and revision of the draft resolution. The Government, the Law Committee of the National Assembly or the Interim Committee shall coordinate with relevant agencies and the Secretary General of the National Assembly to study, explain, absorb and revise the draft resolution;
e) The Standing Committee of the National Assembly shall report to the National Assembly on the explanation and absorption of opinions of the National Assembly deputies and the revision of the draft resolution;
g) The National Assembly votes to approve the draft resolution.
In case the National Assembly considers and approves a draft resolution on the establishment and dissolution of a special administrative-economic unit at two sessions of the National Assembly, the order specified in Article 51 of the National Assembly's Regulations shall apply.
4. The National Assembly shall decide to establish or abolish other agencies in accordance with the Constitution and laws in the following order:
a) A representative of the competent authority presents the report;
b) The representative of the agency in charge of verification presents the verification report;
c) Before discussing at the plenary session of the National Assembly, the National Assembly deputies may discuss at the National Assembly Deputies Group;
d) In the course of discussion at the plenary session of the National Assembly, the competent agency shall explain the opinions of the National Assembly deputies on issues related to the establishment or abolition of the agency;
dd) The National Assembly Standing Committee directs and organizes the study, explanation, reception and revision of the draft resolution. The submitting agency and the agency in charge of verification shall coordinate with relevant agencies and the Secretary General of the National Assembly in studying, explaining, absorbing and revising the draft resolution;
e) The Standing Committee of the National Assembly shall report to the National Assembly on the explanation and absorption of opinions of the National Assembly deputies and the revision of the draft resolution;
g) The National Assembly votes to approve the draft resolution.

1. Government report or report.
2. Draft resolution.
3. Verification report of the agency of the National Assembly.
4. For submission to the National Assembly for decision on state budget estimates and annual central budget allocation, investment guidelines for national target programs and national important projects, the dossier must also include a report. opinion of the State Auditor. For submission to the National Assembly for approval of the state budget finalization, the dossier also contains the State Auditor's report on the state budget finalization audit.

In Article 50 of the National Assembly's Regulations promulgated together with Resolution 71/2022/QH15 (effective from March 15, 2023), there are regulations on order of the National Assembly to consider and decide on important socio-economic issues at a National Assembly session as follows:
1. The Government representative presents the report or report.
2. The representative of the agency in charge of verification shall present the verification report.
3. Representatives of agencies or organizations shall report to the National Assembly on relevant fields as assigned by the National Assembly Standing Committee.
4. Before discussing at the plenary session of the National Assembly, the National Assembly deputies may discuss at the National Assembly Delegation Group, the Ethnic Council, or the National Assembly's Committee.
5. During the discussion at the plenary session of the National Assembly, a member of the Government shall explain the opinions of the National Assembly deputies on issues related to the report, report and draft resolution.
6. The National Assembly Standing Committee shall direct the agency in charge of verification to coordinate with relevant agencies and the Secretary General of the National Assembly in studying, explaining, absorbing and revising the draft resolution; report to the National Assembly on the explanation, absorption of opinions of the National Assembly deputies and revision of the draft resolution.
7. The National Assembly votes to approve the draft resolution.
