In cases where a police officer or soldier is accused of transferring work to another police agency or unit and holding the position of Head or Deputy Head of that Police agency or unit, the Head of that agency or unit shall The immediate superior police officer of the agency, unit of officers and soldiers currently working takes charge of the settlement; Heads of police agencies and units that managed police officers and soldiers who were denounced at the time of the law violations cooperated in resolving them;

- In case a police officer or soldier is accused of transferring work to another police agency or unit that is not covered by points a and b of this clause, the head of the police agency or unit will manage the officer, the soldier who is accused at the time of the law violation takes the lead in resolving it; Heads of police agencies and units managing accused officers and soldiers coordinate to resolve the matter;

- In case the accused person is no longer a police officer or soldier, the head of the police agency or unit has the authority to resolve the denunciation against the police officer or soldier at the time of the violation take the lead in resolving them; Heads of relevant agencies and organizations coordinate to resolve the problem.

What are responsibilities of agencies, units and individuals within the People’s Public Security Force that have authority to resolve denunciations in Vietnam?

Pursuant to Article 7 of Decree 22/2019/ND-CP regulating responsibility for resolving denunciations and coordination in resolving denunciations as follows:

1. Agencies, units and individuals within the People’s Public Security Force have the authority to resolve denunciations within the scope of their duties and powers and are responsible for:

a) Resolve denunciations in accordance with the provisions of law; apply necessary measures to prevent possible damage; ensure the safety of whistleblowers and relatives of whistleblowers; Strictly handle agencies, units, officers, soldiers of the Police, other agencies, organizations and individuals that violate the law and take responsibility before the law for their decisions;

b) Ensure the legitimate rights and interests of the accused in the People’s Public Security Force when there is no conclusion on the denunciation content of the person resolving the denunciation.

2. Agencies, units and individuals in the People’s Public Security Force have the authority to resolve denunciations but do not resolve denunciations in accordance with the provisions of law, lack responsibility in resolving denunciations or resolving denunciations If they violate the law, they must be strictly handled according to the provisions of law and regulations of the Ministry of Public Security; If causing damage, compensation must be made according to the provisions of law.

3. Within the scope of their duties and powers, relevant agencies, units, organizations and individuals are responsible for coordinating with denunciation handlers in the People’s Public Security Force; Provide information and documents related to the denunciation content according to the provisions of law; Apply measures to protect whistleblowers according to authority; Handle people who violate the law according to the conclusion of the denunciation; Handle agencies, units, organizations and individuals that violate the law on denunciation.

In the above case, based on Point d, Clause 9, Article 5 of Decree 22/2019/ND-CP, the Head of District Y police agency has the authority to preside over the settlement of denunciations regarding corrupt acts of Police X in Vietnam.
