What is amount of monthly allowance for servicemen who have demobilized, been discharged, or resigned in Vietnam from November 1, 2024?

On September 17, 2024, the Minister of National Defence issued Circular 53/2024/TT-BQP regulating the adjustment of monthly allowances for servicemen, cipher workers receiving salaries equivalent to servicemen who have demobilized, been discharged, or resigned in Vietnam, which takes effect from November 1, 2024.

Based on Article 3 of Circular 53/2024/TT-BQP which prescribes the calculation and adjustment rates:

Article 3. Calculation and adjustment rates

1. An increase of 15% on the monthly allowance of June 2024 for the subjects stipulated in clauses 1 and 2 of Article 2 of this Circular, according to the following formula:

Monthly allowance from July 2024 = Monthly allowance at the time of June 2024 x 1.150

Thus, the monthly allowance for demobilized, discharged, and resigned servicemen from November 1, 2024, is as follows:

- From 15 years to under 16 years, the allowance is 2,628,000 VND/month;

- From 16 years to under 17 years, the allowance is 2,746,000 VND/month;

- From 17 years to under 18 years, the allowance is 2,868,000 VND/month;

- From 18 years to under 19 years, the allowance is 2,988,000 VND/month;

- From 19 years to under 20 years, the allowance is 3,105,000 VND/month.

What is the duration and age limit for active services for professional servicemen in Vietnam?

Based on Article 17 of the Law on Professional servicemen, Workers, and Defense Officials 2015, which stipulates the duration and age limit for active services for professional servicemen in Vietnam:

Article 17. Duration and age limit for active services for professional servicemen

1. The service time of professional servicemen in peacetime is as follows:

a) Serve for a minimum term of 06 years from the date of decision to become a professional soldier;

b) Serve until reaching the age limit stipulated in clause 2 of this Article.

2. The highest age limit for active service of professional servicemen by military rank:

a) Professional soldier officers: male 52 years old, female 52 years old;

b) Major, Lieutenant Colonel professional servicemen: male 54 years old, female 54 years old;

c) Colonel professional servicemen: male 56 years old, female 55 years old.

3. Professional servicemen with high professional and technical expertise, political and moral qualities, and adequate health, who voluntarily opt for extended service and fulfill the military's requirements, may have their service extended by no more than 05 years.

4. Combatants who reach 40 years of age and who are assigned tasks shall be prioritized for training, retraining, and reassignment to other positions suitable to military needs or transferred to another sector. If the military cannot continue to use them or transfer them to another sector, those with at least 20 years of social insurance contributions, with at least 15 years as combatants, shall be retired.

The list of combatant positions is stipulated by the Minister of National Defence.

Thus, the duration and age limit for active services for professional servicemen in Vietnam is specified as follows:

- Professional soldier officers: male 52 years old, female 52 years old

- Major, Lieutenant Colonel professional servicemen: male 54 years old, female 54 years old

- Colonel professional servicemen: male 56 years old, female 55 years old

What are the rights and obligations of professional servicemen in Vietnam?

Based on Article 6 of the Law on Professional servicemen, Workers, and Defense Officials 2015, which stipulates the rights and obligations of professional servicemen in Vietnam:

[1] Rights of professional servicemen

- The State ensures a decent material and spiritual life, policies, and preferential treatments suitable to the duties of the People's Army.

- They are entitled to training, retraining to improve political, military, legal, and professional technical levels suitable for their position and title.

- They enjoy other rights as prescribed by law.

[2] Obligations of professional servicemen

- Absolutely loyal to the Fatherland, the People, the Communist Party, and the Socialist Republic of Vietnam.

- Strictly observe the Party's guidelines, State policies, legal regulations, and military discipline; always ready to complete all assigned tasks.

- Absolutely obey orders from superiors; when receiving orders from a commander, if there is evidence that the order is illegal, contrary to regulations or codes of the People's Army, they must immediately report to the person giving the order; if still required to comply, report promptly to the direct superior of the person giving the order and not bear responsibility for the consequences of complying with that order.

- Protect the property and interests of the State, military, agencies, organizations; protect life, health, property, and legitimate rights and interests of individuals.

- Study politics, military, law, culture, science, technology, and profession; consolidate organizational skills, discipline, and physical fitness; and increase political resolve and combat readiness according to each subject's requirements.

- Professional servicemen must perform their fighting duties, be ready to fight and sacrifice to protect the independence, sovereignty, unity, and territorial integrity of the Fatherland; protect the People, the Party, the State, and socialist policies; fulfill international obligations; comply with the regulations and charters of the People's Army, and other obligations of servicemen as stipulated by the Constitution and law.
