What is allowance for unexpected difficulties for families and relatives of non-commissioned officers and servicemen of the People's Public Security Force in Vietnam? I am a non-commissioned officer of the People's Public Security Force, recently due to floods and storms, my house collapsed, can I get any allowance or support? Are the natural and legally adopted children of non-commissioned officers and servicemen exempt from tuition fees when studying at preschool educational institutions in Vietnam?

What is allowance for unexpected difficulties for families and relatives of non-commissioned officers and servicemen of the People's Public Security Force in Vietnam?

Pursuant to Article 4 of the Joint Circular 14/2013/TTLT-BCA-BTC guiding the implementation of Decree 87/2013/ND-CP stipulating the unexpected difficulty allowance regime as follows:

1. Families and relatives of non-commissioned officers and servicemen are entitled to unexpected hardship allowances in the following cases:

a) Families of non-commissioned officers and servicemen who have an accident, fire or natural disaster leading to house collapse, house drift, house fire or relocation shall be entitled to a subsidy of VND 2,000,000/rate/time;

b) Relatives of non-commissioned officers and servicemen who are sick for one month or more or receive treatment (both inpatient and outpatient) once at a hospital (medical facility at district level or higher) for seven days or more, shall be entitled to a subsidy of VND 500,000/rate/time;

The hardship allowance specified at Points a and b, Clause 1 of this Article shall be applied not more than twice in a year to an object.

c) Relatives of non-commissioned officers and servicemen who have died or gone missing are entitled to an allowance of 1,000,000 VND/person.

In case, at the same time, the family and many relatives of non-commissioned officers and servicemen are eligible for hardship allowances as prescribed at Points a, b, c, Clause 1 above, they will be supported with corresponding amounts.

For example: In June 2013, the house of comrade Nguyen Van A, a serviceman serving a term at the Provincial Police Department, caught fire and one relative fell ill and had to be treated at the hospital for 10 days. Comrade A's family received a hardship allowance of VND 2,000,000 due to a house fire; 500,000 VND allowance due to 01 sick relative. The total amount of subsidy is 2,500,000 VND (two million five hundred thousand dong).

2. In case family and relatives have many non-commissioned officers and servicemen who are serving for a limited time, non-commissioned officers and servicemen who enlisted first shall make declarations and request for hardship allowances for their families and relatives. When enlisting in the army at the same time, the person with the highest rank in the family is responsible for declaring the request for hardship allowance for the family and relatives.

3. Dossier for consideration of benefits

a) Declaration of request for unexpected hardship allowance of non-commissioned officers and servicemen (made according to form No. 01 ) certified by the People's Committee of the commune, ward or township (hereinafter referred to as commune level) where the family of the non-commissioned officer or serviceman lives.

In case a non-commissioned officer or serviceman has one of the following documents: a certificate from the commune-level People's Committee that the family of the non-commissioned officer or serviceman has collapsed, lost his house, caught fire or has to relocate or his family member is sick for a month or more; hospital discharge paper of the medical facility where the relative has been treated for 07 days or more; a photocopy of the death certificate of a relative, the non-commissioned officer or serviceman shall enclose such documents with the declaration of request for unexpected hardship allowance (not required to obtain certification from the commune-level People's Committee).

b) A written request for an unexpected hardship allowance from the unit directly managing non-commissioned officers and servicemen {at battalion (independent), regiment or equivalent level}.

4. Responsibilities and order of implementation

a) For non-commissioned officers and servicemen

- Make a declaration of request for unexpected difficulty allowance (under form 01 ).

- Submit declarations and related documents (if any) to battalion (independent), regiment or equivalent level.

If the declaration has not been certified by the People's Committee of the commune or attached documents (specified at Point a, Clause 3, Article 4), the non-commissioned officer or serviceman shall submit the declaration to the battalion (independent), regiment or equivalent level to report to the competent authority for approval and settlement of allowances. Within 30 days from the day on which the decision on unexpected hardship allowance is issued, non-commissioned officers and servicemen are responsible for completing the procedures and submitting it to the financial agency for payment and settlement according to regulations. At the end of the above time limit, if non-commissioned officers and servicemen do not complete the procedures, they must refund the received allowance.

b) Responsibilities of commune-level People's Committees

Upon receipt of a declaration requesting an unexpected hardship allowance from a non-commissioned officer or serviceman, or upon a request by a family member of a non-commissioned officer or serviceman, within 05 working days, complete the inspection and certification of the contents stated in the declaration or issue the papers specified at Point a, Clause 3, Article 4 of this Circular.

c) For units managing non-commissioned officers and servicemen at battalion (independent), regiment or equivalent level.

- Receive declarations and papers submitted by non-commissioned officers and servicemen;

- Summarize, examine and request immediate superiors to consider and support unexpected difficulties within 2 working days from the date of receipt of the declaration submitted by non-commissioned officers and servicemen;

- Within no more than 02 working days, receive and pay unexpected hardship allowances for non-commissioned officers and servicemen upon decision of competent authorities.

d) For the police of units and localities

Within 03 working days after receiving complete dossiers from subordinate units, police of units and localities (Department level; provinces and centrally-run cities) where non-commissioned officers and servicemen are working shall complete the consideration and decision on unexpected hardship allowances for families and relatives of such non-commissioned officers and servicemen.

In the above case, based on Point a, Clause 1, you are a non-commissioned officer of the People's Public Security Force in Vietnam. When your family collapses due to storms and floods, you will receive a subsidy of VND 2,000,000/rate/time.

Are the natural and legally adopted children of non-commissioned officers and servicemen exempt from tuition fees when studying at preschool educational institutions in Vietnam?

Pursuant to Article 5 of Joint Circular 14/2013/TTLT-BCA-BTC guiding the implementation of Decree 87/2013/ND-CP stipulating the tuition fee exemption regime as follows:

1. Legally adopted children and children of non-commissioned officers and servicemen are exempt from tuition fees when studying at public and non-public preschool and general education institutions in accordance with current law provisions on tuition fee exemption and reduction regimes.

a) The period of enjoyment of the tuition exemption regime for the children of non-commissioned officers and servicemen is counted from the date of issue of the "Certificate of entities entitled to the tuition exemption regime" until the non-commissioned officers and servicemen complete their definite service in the People's Police.

b) If during the service time of non-commissioned officers and servicemen, there are subjects eligible for tuition exemption regime, non-commissioned officers and servicemen shall make additional declarations; the period of enjoyment of the regime corresponds to the remaining service time of non-commissioned officers and servicemen.

2. Dossier and order, responsibility for implementation

a) For non-commissioned officers and servicemen

- Make a declaration requesting the grant of a certificate of subjects entitled to the tuition exemption regime (made according to form No. 02);

- Submit the affidavit and photocopy of the child's birth certificate to the company, battalion or equivalent level;

- After receiving the "Certificate of entities entitled to the tuition fee exemption regime" (made according to form No. 03), it shall be sent to the family for submission to the preschool or general education institution to implement the regime as prescribed.

b) For company, battalion or equivalent level

- Receive dossiers submitted by non-commissioned officers and servicemen;

- Within 02 working days from the date of receipt of complete dossiers submitted by non-commissioned officers and servicemen, synthesize and propose to their immediate superiors to consider and issue "Certificate of entities entitled to tuition exemption regime". In case, after examining the dossier, it is discovered that it is not in accordance with the provisions of Point a above, the non-commissioned officer and serviceman shall be requested to supplement and complete the dossier in accordance with regulations.

- Receive certificates and deliver them to non-commissioned officers and servicemen.

c) For regimental level and equivalent

Within 03 working days from the date of receipt of the complete dossier requested by the subordinate unit, complete the consideration and issue the "Certificate of entities entitled to the tuition exemption regime" to the children of non-commissioned officers and servicemen.

d) For preschool and general education institutions

- Public preschool and general education institutions

+ Receive the "Certificate of entities entitled to the tuition-free regime" transferred by the family of non-commissioned officers and servicemen;

+ Implement the tuition fee exemption regime for beneficiaries according to the Government's regulations.

- Non-public preschool and general education institutions

+ Receive the Application and "Certificate of entities entitled to the tuition exemption regime" transferred by the family of non-commissioned officers and servicemen;

+ Within 05 working days from the date of receipt of complete dossiers submitted by families of non-commissioned officers and servicemen; certify in the application for tuition reimbursement for the competent authority to pay the tuition reimbursement according to the Government's regulations.

Thus, the legal biological and adopted children of non-commissioned officers and servicemen are exempt from tuition fees when studying at preschool educational institutions. The period of enjoyment of the tuition-free regime for the children of non-commissioned officers and servicemen is counted from the date of issuance of the "Certificate of entities entitled to the tuition-free regime" until the non-commissioned officers and servicemen complete their definite service in the People's Public Security.
