What is abolition of administrative procedures for changing cooperative registration agency in Vietnam?
In Section a Subsection 1 Section III Plan to reduce and simplify regulations related to business activities within the scope of management functions of the Ministry of Planning and Investment issued together with Decision 1505/QD-TTg In 2022, regulations on administrative procedures for changing the cooperative registration agency will be abolished as follows:
a) Administrative procedure 1: Change of cooperative registration agency (1.004895)
- Content of reduction and simplification: Abolish the procedure for changing the cooperative registration agency (Cooperative).
Reason: This procedure is only for cooperatives established before 2012 that registered at the provincial business registration agency, then transferred to register at the district business registration agency. Up to now, the deadline for conversion as prescribed in Clause 2, Article 62 of the 2012 Law on Cooperatives has expired.
- Recommendations for implementation:
+ Development of the Law on Cooperative Economic Organizations and documents under the Law to replace the 2012 Law on Cooperatives and related documents.
+ Implementation roadmap: Period 2022 - 2023.

Administrative procedure 2: Reissue of cooperative registration certificate (1.004901)
- Content of reduction and simplification: Abolish procedures for renewing cooperative registration certificates.
Reason: This procedure is only for cooperatives that have registered their business before the 2012 Law on Cooperatives took effect and wish to change from "Business Registration Certificate" to "Cooperative Registration Certificate".
- Recommendations for implementation:
+ Development of the Law on Cooperative Economic Organizations and documents under the Law to replace the 2012 Law on Cooperatives and related documents.
+ Implementation roadmap: Period 2022 - 2023.

Reason: This procedure is only for cooperative unions that have registered their business before the 2012 Law on Cooperatives took effect and wish to change from "Business Registration Certificate" to "Cooperative Federation Registration Certificate" .

In Section a, Subsection 2, Section III Plan to reduce and simplify regulations related to business activities within the scope of management functions of the Ministry of Planning and Investment issued together with Decision 1505/QD-TTg In 2022, the group of administrative procedures for registering to establish cooperatives (1.005280) and registering to establish cooperative unions (1.005125) will be reduced as follows:
- Content reduced and simplified:
+ Combine 02 administrative procedures into 01 administrative procedure "Registration for establishment of cooperative economic organizations with legal status (cooperative economic organizations that have legal status)".
+ Remove the profile component "Production and business plan".
+ Reduce time to resolve administrative procedures from 05 days to 03 days.
+ Added regulations on online application submission and result return methods to encourage cooperative economic organizations that have legal status women to carry out online procedures.
+ Additional dossier components: Copy of legal documents or identification numbers of legal representatives, individual members and authorized representatives of organizational members and registration certificate Investment registration for foreign investors is similar to business registration.
Reason:
+ Administrative procedures for cooperative unions carry out the decentralization of authority to resolve administrative procedures to the Finance - Planning Department under the district-level People's Committee according to the plan approved in Decision No. 1015/QD-TTg dated August 30, 2022 of the Prime Minister.
+ Reducing document components and processing time helps save time and costs of implementing administrative procedures.
+ The online submission of administrative procedures documents will be used more because the regulations on implementing administrative procedures are flexible and quick, meeting the practical situation of cooperative economic organizations that have legal status.
