What qualification of degree must the Military Commander of commune have in Vietnam?
In Article 17, Joint Circular 01/2013/TTLT-BNV-BQP stipulates appointment of the Military Commander of commune as follows:
Appointment of Commander
1. Conditions for consideration and appointment
In the planning area, the position of Commander; Have a diploma of intermediate professional military level or higher.
2. General standards
a) Comply with the provisions of Article 3 of Decree No. 112/2011/ND-CP dated December 5, 2011 of the Government on civil servants of communes, wards and towns;
b) Ensure the standards specified in Clause 1, Article 2 and the capacity to perform the tasks specified in Article 4 of Circular No. 06/2012/TT-BNV dated October 30, 2012 of the Ministry of Home Affairs guiding on positions responsibilities, specific standards, tasks and recruitment of civil servants in communes, wards and towns.
3. Specific standards for Commanders:
a) Must have a professional intermediate military diploma or higher;
b) Have the ability to advise the Party Committee and Commune People's Committee to issue leadership documents and direct the organization and implementation of national defense work, militia and self-defense work, and defense and security education and civil defense; building the all-people national defense and people's security posture at the commune level;
c) Effectively advise the Party Committee and commune-level authorities in leading and directing the implementation of regimes and policies for militia and self-defense forces, reserve forces, and military rear policies.
d) Develop and organize the completion of defense and military tasks at the commune level.
4. Appointment authority
The Chairman of the District People's Committee decides to appoint the Commander of the Commune-level Military Command at the request of the Chairman of the Commune-level People's Committee after reaching agreement with the Commander of the District-level Military Command.
Thus, the Military Commander of commune must have a diploma of intermediate professional military level or higher in Vietnam.
In addition, the person appointed as Military Commander of commune must also meet general standards in Vietnam and must meet the following conditions:
- Able to advise the Party Committee and Commune People's Committee to issue leadership documents and direct the organization and implementation of national defense work, militia and self-defense work, defense and security education and civil defense; build the all-people national defense and people's security posture at the commune level;
- Effectively advise the Party Committee and commune-level authorities in leading and directing the implementation of regimes and policies for militia and self-defense forces, reserve forces, and military rear policies.
Build and organize the completion of defense and military tasks at the commune level.
Regarding appointment authority, the Chairman of the District People's Committee decides to appoint the Commander of the Commune-level Military Command at the request of the Chairman of the Commune-level People's Committee after agreeing with the Military Commander of district.

07 cases of resignation from positions in the Commune-level Military Command?
In Article 20, Joint Circular 01/2013/TTLT-BNV-BQP stipulates cases of resignation from positions in the Commune-level Military Command including:
(1) Not subject to planning for cadres, civil servants and part-time activists at the commune level.
(2) According to legitimate wishes and application for resignation approved by the District People's Committee.
(3) Have 2 consecutive years being evaluated by the competent authority as "not completing the task".
(4) Fail to comply or obey the organization's assignments.
(5) Disciplinary action in the form of demotion or dismissal.
(6) During the period of being sent for training, he/she is forced to drop out of school.
(7) Retirement and leave.
