Pursuant to Article 5 of the Decree 33/2023/NĐ-CP stipulating the positions and titles of commune-level civil servants and cadres in Vietnam as follows:
(1) Commune-level cadress include the following 8 positions:
- Secretary and Deputy Secretary of the Party Committee
- Chairman and Vice Chairman of the People's Council
- Chairman and Vice Chairman of the People's Committee
- Chairman of the Vietnam Fatherland Front
- Secretary of the Ho Chi Minh Communist Youth Union
- President of the Vietnam Women's Union
- President of the Vietnam Farmers' Association (applicable to communes, wards, and towns with agricultural, forestry, fishery, and salt production activities and with the Vietnam Farmers' Association)
- President of the Vietnam Veterans Association
(2) Commune-level civil servants include the following 6 positions:
- Chief of the Commune Military Command
- Office - Statistics
- Land administration - construction - urban planning and environment (for wards or towns) or land administration - agriculture - construction and environment (for communes)
- Finance - Accounting
- Justice - Registry
- Culture - Society
In Vietnam: In which cases do commune-level cadres who are no longer in office not receive severance pay?
Pursuant to Article 27 of the Decree 33/2023/NĐ-CP stipulating termination of office for commune-level cadres and termination of employment for commune-level cadres and public servants as follows:

1. Cadres at the commune level who resign from their positions and civil servants at the commune level who resign from their jobs (except in cases of transfer and cases of disciplinary action under the regulations of the law on civil servants) are entitled to the benefits of severance pay for cadres at the commune level, severance pay for cadres at the commune level, and are calculated according to the regulations of the Government on severance pay for civil servants.
2. If the Head of the Military Command of the Commune is disciplined by the form of dismissal and cannot be assigned or arranged to another cadre position at the commune level, then the severance pay will be resolved within 30 days from the date of the disciplinary decision taking effect. In addition to the severance pay benefits enjoyed under the provisions of Clause 1 of this Article, the Head of the Military Command of the Commune also enjoys other severance pay benefits under the regulations of the law on the people's militia.
3. Funding sources for payment of position severance allowances for commune-level cadres and severance allowances for commune-level cadres are allocated in the regular operating expenditure estimate of the Commune People's Committee assigned annually by the competent authority.
As regulations above, commune-level cadres who are no longer in office do not receive severance pay in following cases:

Pursuant to Article 28 of the Decree 33/2023/NĐ-CP stipulating retirement of commune-level cadres as follows:
Retirement for commune-level officials
1. Commune-level officials are entitled to retire in accordance with the regulations of labor law and the regulations of the Party and political-social organizations at the central level.
2. Before 6 months from the date of retirement of commune-level officials, the competent authority managing commune-level officials must notify in writing of the retirement date; before 3 months from the date of retirement of commune-level officials, the competent authority managing commune-level officials must issue a retirement decision.
Therefore, the deadline for the competent authority managing commune-level officials to notify commune-level officials of their retirement is 6 months.
