What are the fines for flashing in public in Vietnam?

Pursuant to Clause 5 Article 7 of the Decree 144/2021/NĐ-CP stipulating as follows:

5. A fine ranging from 5.000.000 VND to 8.000.000 VND shall be imposed for any of the following violations:

a) Deliberately inflicting injuries or bodily harm to another person but not liable to criminal prosecution;

b) Disrupting public order while carrying cold weapons, combat gears or other items that can cause injuries;

c) Filming, photographing, charting an restricted area that is relevant to defense and security;

d) Molestation of a person under 16 but not liable to criminal prosecution;

dd) Molestation, sexual harassment;

e) Engaging in sexual acts in public;

g) Perform designing, manufacturing, repairing, maintaining, testing UAVs or ultralight aircrafts, engines, propellers and parts thereof against the categories or quality specified in the license issued by a competent authority;

h) Using UAVs and ultralight aircrafts to launch, drop harmful or dangerous objects or substances without permission.

As regulations above, the man, who flashed in front of womens in the article, shall be fined from 5.000.000 VND to 8.000.000 VND.

In Vietnam, how shall the act of watching under-16-year-old person performing erotic dance be criminally handled?

Pursuant to Article 147 of the Criminal Code in 2015 (amended by Clause 2 Article 2 of the Law on Amendments to the Criminal Code in 2017) stipulating employment of a person under 16 for pornographic purposes in Vietnam as follows:

1. Any person aged 18 or over who persuades, entices, forces a person under 16 to participate in a pornographic performance or watch a pornographic performance in any shape or form shall face a penalty of 06 - 36 months' imprisonment.

2. This offence committed in any of the following circumstances carries a penalty of 03 - 07 years' imprisonment:

a) Organized crime;

b) The offence has been committed more than once;

c) The offence is committed against 02 or more people;

d) The offence is committed against a person for whom the offender is responsible for providing care, education or medical treatment;

dd) The offence is committed for commercial purposes;

e) The victim suffers from 31% - 60% mental and behavioral disability because of the offence;

g) Dangerous recidivism.

3. This offence committed in any of the following circumstances carries a penalty of 07 - 12 years' imprisonment:

a) The victim suffers from ≥ 61% mental and behavioral disability because of the offence;

b) The offence results in the suicide of the victim.

4. The offender might be prohibited from holding certain positions, practicing his/her profession or doing certain jobs for 01 - 05 years.

As regulations above, anyone watching under-16-year-old person performing erotic dance shall be fined 06 - 36 months' imprisonment.

In Vietnam, how shall the act of producing pornographic products be criminally handled?

Pursuant to Article 326 of the Criminal Code in 2015 (amended by Clause 124 Article 1 of the Law on Amendments to the Criminal Code in 2017) stipulating distribution pornographic materials in Vietnam as follows:

1. Any person who makes, duplicates, publishes, transports, deals in, or possesses books, magazines, pictures, films, music, or other items that contain pornographic contents for the purpose of distributing them or distributes pornographic materials in any of the following circumstances shall be a fine of from VND 10,000,000 to VND 100,000,000 or face a penalty of up to 03 years' community sentence or 06 - 36 months' imprisonment:

a) The offence involves an amount of digital data from 01 GB to under 05 GB in size;

b) The offence involves 100 - 199 physical pictures;

c) The offence involves 50 - 99 physical books, magazines or other printed materials;

d) Pornographic materials are distributed among 10 - 20 people;

dd) The offender has incurred an administrative penalty for any of the offences specified in this Article or has an unspent conviction for the same offence .

2. This offence committed in any of the following circumstances carries a penalty of 03 - 10 years' imprisonment:

a) The offence is committed by an organized group;

b) The offence involves an amount of digital data from 05 GB to under 10 GB in size;

c) The offence involves 200 - 499 physical pictures;

d) The offence involves 100 - 199 physical books, magazines or other printed materials;

dd) Pornographic materials are distributed among 21 - 100 people;

e) Pornographic materials are provided for a person under 18;

g) The offence is committed using the Internet, a computer network, telecommunications network, or electronic device;

h) Dangerous recidivism.

3. This offence committed in any of the following circumstances carries a penalty of 07 - 15 years' imprisonment:

a) The offence involves an amount of digital data of ≥ 10 GB;

b) The offence involves ≥ 500 physical pictures;

c) The offence involves ≥ 200 physical books, magazines or other printed materials;

d) Pornographic materials are distributed among ≥ 101 people.

4. The offender might also be liable to a fine of from VND 5,000,000 to VND 30,000,000 or prohibited from holding certain positions or doing certain jobs for 01 - 05 years.

As regulations above, depending on seriousness of the situation, anyone producing pornographic products shall be fined from VND 10,000,000 to VND 100,000,000, 03 years' community sentence or 06 - 36 months' imprisonment.

The offender might be prohibited from doing certain jobs for 01 - 05 years.
