What are the duties and powers of the Department of Culture, Sports and Tourism of Vietnam in the field of tourism?

Pursuant to Clause 13 Article 2 of the Circular 08/2021/TT-BVHTTDL stipulating duties and powers of the Department of Culture, Sports and Tourism of Vietnam in the field of tourism as follows:

13. About tourism:

a) Organize the investigation, assessment, classification, database building, management, protection, conservation, exploitation, rational use, and development of local tourism resources;

b) Implement measures to manage the tourism environment, tourist areas, and tourist spots in the locality; give opinions on tourism development projects in the area;

c) Research, survey, and select locations with potential for community tourism development; propose policies to support the initial necessary equipment and foster knowledge and skills to serve tourists for individuals and households in the community participating in providing tourism services; support the promotion of community tourism products;

d) Assess and submit to the provincial People's Committee for a decision to recognize the provincial tourist area and tourist spot in the locality; organize the preparation of a dossier and submit it to the provincial People's Committee for a request to the Ministry of Culture, Sports, and Tourism to recognize the national tourist area; and organize the announcement after receiving the decision on recognition.

dd) Issue, re-grant, adjust, extend, and withdraw the license to establish a representative office of the foreign tour operator located in the locality; receive the travel agent's written notice on the time of business operation, business location, and information about the travel agency assignment enterprise; grant, re-grant, change, and revoke licenses for domestic travel service businesses according to the provisions of law;

e) Appraise, recognize, and announce the list of 1-star, 2-star, and 3-star tourist accommodation establishments and other tourist service business establishments that meet the standards of serving tourists; organize the inspection and supervision of the minimum conditions on material and technical foundations and services of tourist accommodation establishments; assess the quality of other tourist service business establishments meeting the standards of serving tourists; revoke the recognition decision in case the tourist accommodation establishment or other tourist service business fails to maintain the quality according to the recognized standard;

g) Receive a written notice from the tourist accommodation establishment before it goes into operation or there is a change in name, type, size, address, information about the legal representative, and commitment to fully meet the conditions for providing tourist accommodation services as prescribed by law;

h) Receive written notices from organizations and individuals directly trading tourism products that pose a risk to the life and health of tourists before starting their business and organize the inspection; publish a list of organizations and individuals that fully meet the safety measures for tourists on the Department's website;

i) Issue, re-issue, change, and revoke international tour guide cards, domestic tour guide cards, and tour guide cards at points as prescribed by law; inspecting professional training and retraining activities and tourist guide activities in the locality;

k) Formulate local tourism promotion plans and programs in line with national tourism promotion strategies, plans, and programs and organize the implementation after they are approved;

l) Organize knowledge-updating courses and grant certificates of knowledge-updating courses for domestic and international tour guides.

What are the duties and powers of the Department of Culture, Sports and Tourism of Vietnam in the field of cultural heritage?

Pursuant to Clause 1, Article 2 of the Circular 08/2021/TT-BVHTTDL stipulating duties and powers of the Department of Culture, Sports and Tourism of Vietnam in the field of cultural heritage as follows:

1. Regarding cultural heritage:

a) Organize the implementation of regulations and solutions for mobilizing, managing, and using resources to protect and promote the value of cultural heritage in the locality after they have been approved;

b) Organize the research, collection, inventory, and documentation of intangible cultural heritage in the locality; grant permits to research and collect intangible cultural heritage in the area for overseas Vietnamese, foreign organizations, and individuals;

c) Manage and guide the organization of activities to protect and promote the value of cultural heritage, traditional festivals, and beliefs associated with relics and historical figures in the locality;

d) Organize inventory, make a list, and compile dossiers for the ranking of historical and cultural relics and scenic spots in the locality;

dd) Appraisal and request for approval of planning tasks and planning for preservation, renovation and restoration of relics under the competence of chairpersons of provincial-level People's Committees; appraise projects on preservation, renovation and restoration of monuments, report on economic and technical aspects of preservation, repair and restoration of relics, for provincial relics, and submit them to the President of the provincial People's Committee for approval; participate in the design of construction drawings for preservation, restoration and restoration of provincial-level monuments; give opinions on dossiers of urgent repair, periodical preservation of relics or objects of relic inventory; appraise projects on renovation and construction of works located outside the provincial-level relic protection zones in the locality that are likely to affect the landscape and environment of the monuments; issue, re-issue and revoke relic restoration practice certificates and practice certificates to relic restoration practice organizations based in their locality;

e) Receive dossiers, guide procedures, and submit to competent authorities for granting permits for archaeological exploration, excavation, and urgent excavation; monitor and supervise the implementation of the content of excavation permits in the locality; review and propose to the President of the People's Committee of the province to adjust the archaeological planning;

g) Appraisal of artifacts and artifact dossiers for requests for national treasure recognition by provincial-level museums, relic management boards or centers, non-public museums, organizations, or individuals as owners or legally managing local objects;

h) Organize the collection and preservation of relics, antiquities and national treasures handed over and confiscated by organizations and individuals in the locality in accordance with law; organize the registration and management of relics, antiquities and national treasures; issue practice certificates to shop owners trading relics, antiquities and national treasures; granting permits to make copies of relics, antiquities and national treasures belonging to national relics, provincial relics, provincial museums and private ownership in the locality; issue, re-issue and revoke certificates of eligibility for antique assessment business, for assessment business establishments located in the locality; to request the Minister of Culture, Sports and Tourism for permission to bring private relics and antiquities abroad for display, exhibition, research or preservation;

i) Confirm the conditions for the establishment of the provincial museum and the conditions for the grant of an operating license for the local non-public museum; consider and decide on sending the written request and the dossier for ranking class II and III museums for provincial-level museums and non-public museums to the chairperson of the provincial-level People's Committee to organize the appraisal of the ranking museum class; make suggestions and proposals for approval of provincial-level museum display projects and local-managed souvenir house display projects;

k) Inspect, supervise, and coordinate with units under the Ministry of Culture, Sports, and Tourism in inspecting training facilities and organizing the implementation of the program on knowledge training on preservation, renovation, and restoration of knowledge to restore historical and cultural relics and scenic spots in the locality;

l) Act as a standing body advising the People's Committee of the province to submit to the People's Council of the province on: naming, renaming streets, squares, and public works in the locality.

What are the duties and powers of the Department of Culture, Sports and Tourism of Vietnam in the field of advertisement? 

Pursuant to Clause 7 Article 2 of the Circular 08/2021/TT-BVHTTDL stipulating duties and powers of the Department of Culture, Sports and Tourism of Vietnam in the field of advertisement as follows:

7. About advertising:

a) Assume the prime responsibility for, and coordinate with relevant departments, agencies, and sectors, in appraising and submitting to the provincial People's Committees for granting, re-granting, amending, supplementing, and revoking the enterprise's representative office establishment license. foreign advertising placed locally;

b) Receive and process dossiers of announcements of advertising products on billboards and banners; notify the organization of a delegation of people performing advertising in the locality;

c) Assist the People's Committee of the province in organizing the formulation, approval, and implementation of the outdoor advertising plan and periodically report on the management of advertising activities in the locality;

d) Inspect and handle, according to its competence, violations of the law on advertising activities on advertising media as prescribed by law.
