Pursuant to Article 18 of Decree 78/2020/ND-CP stipulating the above content as follows:

Standards and conditions for arranging and appointing reserve officer positions

1. Reserve officers have strong political courage and good moral qualities; Be responsible and perform well the task of building a reserve force; exemplary performance of citizen's obligations, responsibilities and duties of job titles and positions, participation in local activities and agencies and organizations where people work, study and work; have credibility with the masses; Have qualifications, military knowledge, and professional skills as required by each position; Reserve officers appointed to positions ranging from company political officer, company commander and equivalent or higher must be members of the Communist Party of Vietnam; Health from type 01 to type 03.

2. Age for first appointment: Platoon leader no more than 35, company officer no more than 40, battalion officer no more than 45, regiment officer no more than 50; Places lacking resources can appoint people at a higher age but not more than 5 years old compared to the age mentioned above.

3. Prioritize the arrangement and appointment of units tasked with mobilizing in a state of high combat readiness, main force units first, local army units second; No spread arrangement according to unit focal points was built and adjusted promptly in case of fluctuations or changes in the reserve officer team.

4. Reserve officers who are appointed to hold positions higher than their initial reserve officer training title or the position they held in the unit upon leaving active duty must receive additional training according to their title; In cases where arrangements and appointments must be made to perfect the organization, additional training must be provided after arrangement and appointment.

What is dismissal from reserve officer position according to the latest regulations in Vietnam?

Pursuant to Article 19 of Decree 78/2020/ND-CP regulating the above content as follows:

Relieved of duty as reserve officer

1. When there is a decision to change the organization, staffing or dissolution of the reserve unit by the competent authority, there is no longer any need to staff the position of the current reserve officer.

2. Reserve officers are arranged and appointed by competent authorities in reserve units or are elected to hold positions in the political system or public service units exempted from military service during the period. 

3. Reserve officers have extremely difficult family circumstances or their health has declined to grade 4 or higher and do not meet the standards and conditions to hold their current positions.

4. Reserve officers who are released from rank by competent authorities are automatically relieved of their positions.

5. Reserve officers are appointed to positions in reserve units when they go abroad to study, work, or work for a year or more or are frequently absent from their place of residence or on duty. If the command to focus on training, inspection, and readiness to mobilize is not strictly followed, if the result of fulfilling responsibilities and tasks is low, then the person will be considered for dismissal.

What are regulations on reserve officer military rank grant and promotion in Vietnam? 

Pursuant to Article 20 of Decree 78/2020/ND-CP regulating the above content as follows:

Granted, promoted to the rank of reserve officer

1. Granted the rank of reserve officer

a) Students graduating from reserve officer training, students graduating from training for Commanders of commune-level military commands of the grassroots military sector are awarded the rank of Second Lieutenant and reserve officers;

b) Students training reserve officers from cadres, civil servants and public employees; Graduated from reserve officer training with good grade or higher, with good training results, based on the assigned position in reserve units and current salary to consider conferring reserve officer rank.

2. Promoted to the rank of reserve officer

Reserve officers who meet the following criteria and conditions will be considered for promotion to military rank:

a) Have good political qualities, ethics, and lifestyle; level of knowledge and capacity corresponding to the position held; During the period of consideration for promotion to military rank, comply well with regulations on registration, management, training, activities and mobilization orders of competent authorities;

b) The position currently held in the reserve unit and the position of Commander of the Commune Military Command requires a higher military rank than the current military rank;

c) Enough time limit for consideration for promotion to reserve officer rank prescribed in Clause 4, Article 41 of the 1999 Law on Officers of the Vietnam People's Army, amended and supplemented with a number of articles in 2008 and 2014.

3. Promoted to reserve officer rank ahead of schedule

Reserve officers have research projects, have valuable initiatives serving national defense or have excellent achievements, have courageous actions in protecting political security, social order and safety, and preventing natural disasters, epidemic, rescue, and being awarded medals will be considered for promotion to military rank ahead of time.
