What are scope, principles and organization of coordinated activities in the performance of border guard duties in Vietnam?
Pursuant to Article 6 of the Decree 106/2021/NĐ-CP stipulating scope, principles and organization of coordinated activities in the performance of border guard duties in Vietnam as follows:
1. The scope and principles of coordination among ministries, ministerial-level agencies and local authorities in the performance of border guard duties shall comply with the provisions of Clauses 1 and 2, Article 10 of the Law on Vietnam Border Guard.
2. The Ministry of National Defense is responsible for coordinating with ministries, ministerial-level agencies and local authorities in performing border guard duties as prescribed in Articles 7 to 27 of this Decree.
3. Based on the functions, tasks, powers and contents of coordination in Clause 3, Article 10 of the Law on Vietnam Border Guard, ministries, ministerial-level agencies and local governments at all levels shall determine forms and methods to coordinate in the effective implementation of border guard duties; to build an all-people border guard, a strong all-people border defense posture, and law dissemination and education in border areas.
4. Based on functions, requirements and tasks, the Border Guards shall assume the prime responsibility for formulating regulations on coordination with agencies, units, functional forces of ministries, ministerial-level agencies and local authorities in accordance with regulations of the Law on Vietnam Border Guard and this Decree.
What are responsibilities of the Ministry of National Defense in the performance of border guard duties in Vietnam?
Pursuant to Article 7 of the Decree 106/2021/NĐ-CP stipulating responsibilities of the Ministry of National Defense in the performance of border guard duties in Vietnam as follows:
1. Assume the prime responsibility for, and coordinate with the Ministry of Foreign Affairs and the Ministry of Public Security in, discussing with ministries, ministerial-level agencies and local administrations where the national border is located on the situation and information related to the management and protection of national borders, crimes and violations of law in border areas and border gates as prescribed by law; share with the Ministry of Public Security on exit, entry, transit, and visa issuance at the border gates managed by the Ministry of National Defense; upon request, notify the Ministry of Public Security of information related to national security, social order and safety, and situation of law violations in border areas and other information related to the functions and tasks of the Ministry of Public Security.
2. Assume the prime responsibility for, and coordinate with ministries, branches and local authorities in building a border defense foundation for all people, and a strong all-people border defense posture where there is a national border.
3. Assume the prime responsibility for, and coordinate with the Ministry of Public Security and local authorities in handling military and defense situations in border areas; direct the Border Guard to coordinate with local police in advising local authorities to handle security and order situations in border areas in accordance with law.
4. Assume the prime responsibility for, and advise the Government on, international cooperation on border guard and border defense diplomacy in accordance with law; give opinions on plannings, schemes and projects of ministries, branches and localities in border areas.
5. Assume the prime responsibility for, and coordinate with ministries, branches and local authorities in building revolutionary, regular, elite, and step-by-step modernized border guards, with a number of components advancing towards modernity; provide professional training on national border management and protection for forces performing border guard duties in border areas.
6. Assume the prime responsibility for, and coordinate with the Ministry of Justice, relevant ministries and branches, and local authorities in monitoring the implementation of the law on border guard; guide, urge and inspect the law-making work on border guard according to the provisions of law.
7. Assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment in, synthesizing medium-term, long-term and annual investment plans of the Border Guard in accordance with the provisions of the Law on Public Investment; identify and include in the list of projects funded by the state budget and prioritized projects for the construction of the Border Guard.
8. Assume the prime responsibility for search, rescue and rescue in forbidden zones, military zones, border areas and border gates under the management of the Ministry of National Defense and for foreign military ships and military aircraft in the border area.
9. Direct the Border Guard to assume the prime responsibility for, and coordinate with the functional forces of the People's Public Security, the force performing the border guard duties of the ministries, ministerial-level agencies and local authorities in maintaining security, social order and safety, crime prevention and control in border areas and border gates under the management of the Ministry of National Defense in accordance with law.
10. Direct agencies and units under their authority to coordinate with agencies, units and functional forces of ministries, ministerial-level agencies and local authorities at all levels to create favorable conditions for Border Guards perform assigned functions, tasks and powers.
11. Coordinate with relevant ministries, branches and localities in the prevention, combat, response and remedy of incidents, natural disasters and disasters; climate change, epidemics in border areas and border gates under the management of the Ministry of National Defense.
12. Coordinate with local authorities where border areas are located to select citizens of ethnic minorities residing in border areas and islands, and talented people to create a source of long-term service in the Border Guard according to annual recruitment and selection plan.
