What are requirements for commune-level justice and civil status officers in Vietnam?

Pursuant to Article 72 of the Law on Civil Status in 2014 stipulating civil status officers as follows:

Civil status officers

1. Civil status officers include justice and civil status officers at commune level; civil status officers in district-level Justice Divisions of district-level People’s Committees; and diplomats and consuls performing civil status work in representative missions.

2. Commune-level justice and civil status officers must meet the following criteria:

a/ Possessing an intermediate or higher degree in law and having been trained in civil status work;

b/ Possessing a legible handwriting and computer skills suitable to their job requirements.

Based on practical conditions of geographical area, population and justice and civil status workload in localities, the Government shall stipulate the assignment of justice and civil status officers on a full-time basis.

3. Civil status officers in district-level Justice Divisions must possess a university or higher degree in law and have been trained in civil status work.

4. Diplomats and consuls performing civil status work in representative missions must have been trained in civil status work.

As regulations above, commune-level justice and civil status officers must meet the following criteria:

- Possessing an intermediate or higher degree in law and having been trained in civil status work;

- Possessing a legible handwriting and computer skills suitable to their job requirements.

What are prohibited acts of civil status officers in Vietnam?

Pursuant to Article 74 of the Law on Civil Status in 2014 stipulating prohibited acts of civil status officers in Vietnam as follows:

- Being authoritarian, harassing, delaying, causing difficulties and troubles, or receiving bribes when performing civil status registration and management.

- Collecting civil status fees higher than prescribed rates or imposing charges for civil status registration.

- Imposing formalities and papers and prolonging the time for civil status registration in violation of this Law.

- Erasing, altering or tampering with information contents in the civil status database.

- Registering or granting papers related to civil status in violation of this Law.

- Revealing personal information known through civil status registration.

- Civil status officers who commit prohibited acts specified in this Article shall, depending on the nature and seriousness of their violations, be disciplined or examined for penal liability in accordance with law.

What are tasks of a Justice - Civil status official in Vietnam?

Pursuant to Clause 5 Article 11 of the Decree 33/2023/NĐ-CP stipulating tasks of a Justice - Civil status official in Vietnam as follows:

- Act as an advisor for the communal People’s Committee to organize performance of tasks and entitlements of the communal People’s Committee and the Chairperson of the communal People’s Committee in fields of justice and civil status in the commune in accordance with law;

- Assist the communal People’s Committee in drafting and promulgating documents according to regulations of law; assist the communal People’s Committee in carrying out surveys on the People’s opinions about legislative documents according to plans of the communal People’s Committee and guidelines of superior authorities;

- Assist the communal People’s Committee in carrying out legal dissemination and education, legal aid, judgment enforcement; monitoring law enforcement and carrying out surveys on the People’s opinions in the commune about participation in law-making; building a commune achieving legal accessibility standards; instructing the operation of grassroots mediation organizations;

Cooperate with village heads, neighborhood leaders in preliminarily reviewing and summarizing grassroots mediation work and reporting results to the communal People's Committee; managing law bookcases at the communal People's Committee; cooperating with socio-cultural officials in guiding residential communities of villages and neighborhoods to formulate and organize the implementation of village conventions;

- Assist the communal People’s Committee in registering and managing civil status as prescribed by law;

- Take charge of affairs of civil status, notarization and authentication at the unit receiving and informing results of the communal People’s Committee;

- Assist the communal People’s Committee in combating and controlling corruption and performing tasks relating to inspection;

- Perform other tasks according to the assignment of the Chairperson of the communal People’s Committee and regulations of relevant laws.
