Pursuant to Article 22 of the Circular 54/2022/TT-BCA (effective from 01/01/2023) stipulating regulations on weapons, explosives, combat gears, vehicles and technical equipment of the Mobile Police in Vietnam as follows:

1. Weapons, explosives, combat gears, vehicles and technical equipment shall be equipped for Mobile Police.

2. Vehicles, including: Cars, motorcycles, special vehicles, boats, helicopters and other vehicles equipped with lights and whistles that give priority signals are entitled to priority according to regulations of law. The two sides of cars, special vehicles, boats and patrol helicopters are printed with reflective mobile police badges; On either side of the fuel tank or on the sides of the tank behind the patrol motorcycle, there are reflective Mobile Police badges.

3. Professional technical equipment includes:

a) Camcorders; cameras, recorders;

b) Flashlight for lighting;

c) Walkie-talkie;

d) Technical and professional equipment and other communications as prescribed by the Ministry of Public Security.

What are regulations on use of weapons, explosives, combat gears, vehicles and technical equipment of the Mobile Police in Vietnam regarding patrol control?

Pursuant to Article 23 of the Circular 54/2022/TT-BCA (effective from 01/01/2023) stipulating use of weapons, explosives, combat gears, vehicles and technical equipment as follows:

1. Priority signal lights and whistles shall be used continuously in the following cases:

a) Patrol and control combat maneuvers;

b) Control at one point or checkpoint in key areas or areas; line, complex objectives in terms of security and order or when there is an important political event.

2. When using weapons, explosives, combat gears, technical means and equipment specified in Article 22 of this Circular, they must strictly comply with the law on use of weapons, explosives, combat gears, vehicles and professional technical equipment.

What are regulations on organization of handling of violations of the law on security and order at the headquarters of the Mobile Police unit in Vietnam?

Pursuant to Article 20 of the Circular 54/2022/TT-BCA (effective from 01/01/2023) stipulating handling of violations of the law on security and order at the headquarters as follows:

1. Organize the handling of violations of the law on security and order:

a) Mobile police units under the police of units and localities competent to handle violations of the law on security and order shall arrange mobile police officers and locations to deal with and handle violations. according to the provisions of law and the Ministry of Public Security;

b) The place to deal with violations of the law on security and order shall be located in a convenient location, have an appropriate and dignified area, and have seats for people to contact for settlement; post up the diagram showing the workplace, the timetable for receiving people; title plate of officials on duty; phone number; regulations on receiving people; comment box and the content of a number of documents related to the handling of violations of the law on security and order.

3. The order of dealing with violations of the law on security and order at the headquarters of the unit is as follows:

a) Receive records of administrative violations from violators and compare them with violation files (in case of losing records of administrative violations, carefully compare personal information of violators with records of violations; offense); failing to settle the case with an intermediary (except for cases authorized by law) or outside the position specified in the settlement of administrative violations of the unit;

b) Notify the form, level of sanction, preventive measures and other measures;

c) Hand over the decision on sanctioning of administrative violations to the sanctioned person or his/her legal representative or authorized person;

d) Receive, examine and compare receipts of fine collection (or other receipts of fine collection and payment as prescribed by law) with records of administrative violations and keep them;

dd) Return material evidences, means and papers temporarily seized according to administrative procedures (except for cases where the use rights are deprived or confiscated) to violators or owners whose material evidences and means are temporarily seized. hold or represent organizations committing administrative violations recorded in decisions on temporary seizure of material evidences and means of administrative violations in accordance with law. If the above-mentioned individuals or organizations authorize others to come and receive the material evidences, means and papers, a written authorization must be obtained in accordance with law. When returning temporarily seized material evidences, means, permits and practice certificates, a decision must be made and a record is made as prescribed;

e) In case violators pay administrative fines via accounts, public postal services, National Public Service Portal, Public Service Portal of the Ministry of Public Security, they shall comply with regulations of law. of current law and of the Ministry of Public Security.
