What are regulations on the working relationship between the Department of Health of Ho Chi Minh City and the Ministry of Health of Vietnam?

Pursuant to Clause 1 Article 19 of the Regulation on the functions, tasks, powers and organizational structure of the Department of Health of Ho Chi Minh City issued together with Decision 29/2022/QD-UBND of Ho Chi Minh City stipulating the working relationship between the Department of Health of Ho Chi Minh City and the Ministry of Health of Vietnam as follows:

1. For the Ministry of Health

a) The Department of Health is subject to the direction, guidance, professional inspection and performance report to the Ministry of Health. The Department of Health attends all meetings and professional training convened by the Ministry of Health and agencies under the Ministry of Health.

b) When the direction and guidance of the Ministry of Health are not suitable with the actual situation of the City or inconsistent with the direction of the City People's Committee, the Department of Health must promptly report and propose to The City People's Committee works with the Ministry of Health or submits to the Prime Minister for consideration and decision.

c) The recommendations of the Department of Health to the Ministry of Health related to major undertakings and policies of the City, the Director of the Department of Health must consult the City People's Committee before reporting.

Pursuant to Clause 2 Article 19 of the Regulation on the functions, tasks, powers and organizational structure of the Department of Health of Ho Chi Minh City issued together with Decision 29/2022/QD-UBND of Ho Chi Minh City stipulating the working relationship between the Department of Health of Ho Chi Minh City and the People's Council and the City People's Committee as follows:

 2. For the People's Council and the City People's Committee

a) The Department of Health is responsible for reporting, providing information and providing documents for the supervision activities of the City People's Council; answer questions and recommendations of the City People's Council deputies on issues under the management of the sector.

b) Department of Health is under the direct and comprehensive direction of the City People's Committee; The Director of the Department is responsible for periodically and irregularly reporting to the City People's Committee and the Chairman of the City People's Committee on the situation and results of the organization and operation of the sector; attending meetings convened by the City People's Committee; organizing and inspecting the implementation of decisions and directions of the City People's Committee for the following areas, for which the Department is assigned.

c) The Director of the Department of Health shall report to and consult the City People's Committee and the Chairman of the City People's Committee to resolve issues beyond the Department's authority. Regarding issues related to the functions, duties and powers of the Department, the Department of Health and other departments, branches, Thu Duc City People's Committee, District People's Committee have different opinions, The Director of the Department of Health must fully report the comments and recommendations of the Department to the City People's Committee and the City People's Committee Chairman for consideration and decision.

Pursuant to Clause 3 Article 19 of the Regulation on the functions, tasks, powers and organizational structure of the Department of Health of Ho Chi Minh City issued together with Decision 29/2022/QD-UBND of Ho Chi Minh City stipulating the working relationship between the Department of Health of Ho Chi Minh City and Party organizations as follows:

3. For Party organizations

The Department of Health cooperates with the Committees of the Party Committee of the City Party Committee and the Party Committee of the Department of Health to receive the leadership and direction orientations of the Standing Committee of the City Party Committee and the Party Committee of the Department of Health; consults the Party Committees of the City Party Committee and the Party Committee of the Department of Health when performing tasks related to the functions, tasks and powers of the Department of Health.
