What are regulations on the uniforms, badges and certificates of the Commune Police in Vietnam?

Pursuant to Article 6 of Decree 73/2009/ND-CP stipulating the uniforms, badges and certificates of the Commune Police in Vietnam as follows:

Pants, winter coats and warm clothes are provided to localities from Thua Thien Hue to the North and 5 provinces of the Central Highlands; the remaining localities are equipped with spring-summer pants and shirts.

2. Costume color:

- Pants, shirts, hats, socks with faded grass color;

- Small brown belt, yellow buckle;

- Black leather shoes.

3. Dress Style

a) Autumn and winter coats:

- Dress in a long-sleeved shirt with a stand-up collar (with a necktie);

- The outerwear is sewn with a long-sleeved veston, the front body has 4 outer pockets, plastic buttons of the same fabric color. On the left hand of the shirt is attached the badge of the Commune Police.

b) Spring-summer shirt with long sleeves and stand collar; Front body has 2 chest pockets sewn on the outside, plastic buttons of the same fabric color. On the left sleeve of the shirt is the insignia of the Commune Police (the shield is 90 mm high, 70 mm wide, the background is green, the border around the badge is yellow, on the background of the badge has the words Commune Police);

c) Pants made in the style of casual pants;

d) A soft hat, with the Commune Police badge on top (a shield, a sword and a yellow five-pointed star in the middle, a half-wheel and a scroll in the middle) yellow, on the background of the letter with the word "Commune Police" in red).

4. Costumes, badges and certificates of the Commune Police must be strictly managed in accordance with the prescribed regime and can only be used when performing official duties.

It is strictly forbidden to illegally lend, rent, buy or sell costumes and badges of the Commune Police.

5. The Minister of Public Security shall specify and guide in detail the models of costumes, badges and certificates of the Commune Police; stipulate the grant, change, revocation and handling of violations in case of loss of Commune Police Certificate.

What are regimes and policies for Chiefs of Commune Police, Deputy Heads of Commune Police and Public Security Officers in Vietnam?

Pursuant to Article 7 of Decree 73/2009/ND-CP stipulating the regimes and policies for Commune Police Chiefs, Commune Police Deputy Heads and Public Security Officers as follows:

1. Commune Police Chiefs, Commune Police Deputy Heads and Public Security Officers are entitled to salary and allowance regimes in accordance with the Government's regulations on regimes and policies applicable to cadres and civil servants in communes, wards and townships.

2. Commune Police Chiefs, Commune Police Deputy Heads and Public Security Officers shall carry out social insurance and health insurance in accordance with the provisions of the Law on Social Insurance and the Law on Health Insurance.

The Ministry of Labor, War Invalids and Social Affairs shall assume the prime responsibility for, and coordinate with the Ministry of Public Security in, guiding the implementation of social insurance and health insurance for Commune Police Heads, Commune Police Deputy Heads and Public Security Officers according to the Law on Social Insurance and Law on Health Insurance.

3. Commune police chiefs who have served continuously for 60 months or more are entitled to a seniority allowance each year equal to 1% of their current salary and allowance; If they have a continuous working period of 15 years or more, if they quit their jobs for legitimate reasons but do not yet meet the conditions for retirement, they will be entitled to a lump-sum allowance for each working year, which is equal to 1.5 months of the average salary and allowance for insurance premium payment.

The seniority allowance is paid monthly in the same salary period and is used to pay and enjoy the social insurance and health insurance regimes.

4. Deputy Chiefs of Commune Police and Public Security Officers who have worked continuously for full 15 years or more, if they quit their jobs for legitimate reasons, they are entitled to a one-time allowance, equal to 1 for each working year. 5 months average current allowance; when sent to focus on training, training and fostering in politics, law and profession, they are entitled to a fostering regime equal to the basic meal rate of soldiers serving a term for the People's Public Security; when going on a business trip, they are entitled to the same benefits as commune-level civil servants.

5. Commune Police Chiefs, Commune Police Deputy Heads and Public Security Officers, when on duty are ready to fight in key areas, complex in security and order, and are entitled to daily allowances by 0.05 times of the general minimum wage. If you are on duty far from your place of residence and have no conditions to go and return every day, the agency that has issued the decision will mobilize you to arrange accommodation, support vehicles, travel expenses or pay for transportation.

6. Commune police chiefs, deputy heads of commune police and public security officers who fall ill during their work are entitled to medical examination and treatment at medical facilities and are supported to pay for medical examination and treatment from the state budget. The specific level of support shall be decided by the chairperson of the provincial People's Committee.

7. Commune Police Chiefs, Deputy Chiefs of Commune Police and Public Security Officers have accidents while on duty while focusing on political, legal and professional training, or on their way to work. On the way, to the place where the political, legal and professional training and retraining will be concentrated on the way, according to the convening decision of the competent authority, they are entitled to the following regimes:

a) To be paid medical expenses during the course of first aid and emergency treatment until the treatment stabilizes the injury and discharge from the hospital;

b) After receiving treatment, he/she is recommended by the Commune People's Committee to have his/her working capacity assessed at the Medical Assessment Council in accordance with law.

If a person participates in social insurance, a lump-sum or monthly allowance shall be provided in accordance with the law on social insurance. In case a person who has not yet participated in social insurance has a working capacity decrease of 5% or more, he/she shall be entitled to a lump-sum allowance, the level of allowance prescribed by the Ministry of Public Security and the Ministry of Labor, War Invalids and Social Affairs. specific instructions;

c) Persons who suffer from an accident that causes defects in one or more body parts or functions, manifests in different forms of disability, reduces their ability to function, and causes difficulties in working or studying shall be entitled to enjoy preferential regimes as prescribed by law for disabled people;

d) In case of death, including death during the first treatment period, if the deceased person is covered by social insurance, the provisions of the law on social insurance shall apply; in case the deceased has not yet participated in social insurance, the person in charge of burial shall receive a funeral payment equal to 08 (eight) months of minimum salary and his/her family shall receive a lump-sum allowance equal to 05 (five) months of minimum wage.

8. Commune police chiefs, commune police deputy heads and public security officers who are injured or die while on duty or for reasons of official duty performance are entitled to regimes and policies as prescribed by the Law on preferential treatment to people with meritorious services to the revolution.

9. Expenses to pay for accident benefits shall be covered by the local budget. For people participating in social insurance, the payment shall be paid by the social insurance fund.

What are regulations on ensuring the funding and facilities for the operation of the Commune Police in Vietnam?

Pursuant to Article 8 of Decree 73/2009/ND-CP stipulating the regulations on ensuring the funding and facilities for the operation of the Commune Police in Vietnam as follows:

1. Funding sources for the operation of the Commune Police include the central budget and the local budget.

2. The State ensures funding and material foundations for the operation, training, coaching, retraining, implementation of regimes, policies and other necessary conditions for the Commune Police.

3. State budget expenditures for the operation of the Commune Police shall be made as follows:

a) Expenditure tasks of the Ministry of Public Security:

- Ensure the training, training and retraining in politics, law and profession for the Commune Police force organized by the Ministry of Public Security and ensure the training regime for the Deputy Chief of the Commune Police and the Public Security members when they are sent to study at such training, coaching and retraining courses;

- Produce, purchase and repair weapons, supporting tools, equipment, samples of costumes, badges, Certificate of Commune Police;

- Expenses for summarizing and rewarding in the construction of the commune police force organized by the Ministry of Public Security;

- Other expenditures for the Commune Police as prescribed by law fall under the responsibility of the Ministry of Public Security.

b) Local expenditure tasks:

- Pay salaries, allowances and pay social insurance and health insurance premiums.

- Implementation of regimes and policies: fostering, allowance, sickness, maternity, accident, injury, sacrifice or death;

- Expenses for the training, training and fostering of politics, law and profession organized by the locality and ensuring the training regime for the Deputy Chiefs of the Commune Police and the Public Security Officers when they are sent to study at the local police station. those training, coaching and retraining sessions;

- Procurement of costumes, badges and print, issue the Certificate of Commune Police according to the form prescribed by the Ministry of Public Security;

- Expenses for preliminarily reviewing, summarizing and rewarding units, organizations and individuals that have made achievements in the construction of the commune police force organized by the locality;

- Other expenses for the Commune Police as prescribed by law are the responsibility of the locality.

For a number of expenditure tasks, if the social insurance and health insurance regimes have been implemented, they shall be paid by the social insurance agency, the state budget shall not perform these expenditure tasks;

c) The estimation, execution and finalization of the budget to ensure the operation of the Commune Police shall comply with the provisions of the Law on State Budget and its guiding documents.

4. The Ministry of Finance shall assume the prime responsibility for, and coordinate with concerned ministries and branches in, ensuring funding for the implementation of the Ordinance on Commune Police and this Decree in accordance with the provisions of the Law on State Budget.
