Pursuant to Article 18 of the Regulation on protection of state secrets in Ho Chi Minh City issued together with Decision 22/2022/QD-UBND of Ho Chi Minh City stipulating the term of protection of state secrets and extension of time limit for protection of state secrets in Ho Chi Minh City as follows:

1. The term of protection of state secrets shall comply with the provisions of Article 19 of the Law on Protection of State Secrets 2018.

2. Extension of the time limit for protection of state secrets shall comply with the provisions of Article 20 of the Law on Protection of State Secrets 2018.

Pursuant to Article 19 of the Regulation on protection of state secrets in Ho Chi Minh City issued together with Decision 22/2022/QD-UBND of Ho Chi Minh City stipulating adjustment of confidentiality, declassification and destruction of documents and containers containing state secrets in Ho Chi Minh City as follows:

1. Confidentiality adjustment shall comply with the provisions of Article 21 of the Law on Protection of State Secrets 2018.

2. Declassification shall comply with the provisions of Article 22 of the Law on Protection of State Secrets 2018.

3. The destruction of documents and containers containing state secrets shall comply with the provisions of Article 23 of the Law on Protection of State Secrets 2018.

What are regulations on the inspection, examination, settlement of complaints and denunciations, and monitoring of the implementation of the law on protection of state secrets in Ho Chi Minh City?

Pursuant to Article 20 of the Regulation on protection of state secrets in Ho Chi Minh City issued together with Decision 22/2022/QD-UBND of Ho Chi Minh City stipulating the inspection, examination, settlement of complaints and denunciations, and monitoring of the implementation of the law on protection of state secrets in Ho Chi Minh City as follows:

1. Assign the City Police to assume the prime responsibility for, and coordinate with relevant agencies and units in, inspecting and examining the protection of state secrets according to its competence to agencies, units and localities; Unscheduled inspection and examination shall be conducted when detecting that agencies, units, localities and individuals show signs of violations of the law on protection of state secrets and deems it necessary to conduct inspection and examination.

The inspection in the field of state secret protection is chaired by the City Police Inspector and advises competent authorities to organize the inspection according to regulations. The inspection of the field of state secret protection is chaired by the Internal Political Security Department - City Public Security and advises the competent authorities to organize the inspection according to regulations.

2. Inspection and examination in the field of state secret protection shall be carried out periodically or irregularly for each case or for each individual, each stage of work, each agency or unit, local.

3. Heads of agencies and organizations are responsible for conducting periodic or irregular inspection in the field of state secret protection for each unit within their management. Periodic inspection must be carried out at least every three years.

4. The inspection and examination in the field of protection of state secrets must properly assess the advantages and disadvantages; detect shortcomings, loopholes and recommend remedial measures. After each inspection or examination, it must report to the superior managing agency and concurrently send it to the police agency of the same level for monitoring.

5. When there is a complaint or denunciation in the field of state secret protection, the City Police Inspector shall coordinate with relevant agencies, units and localities to settle them in accordance with the law on resolve the complaint report.

6. The City Police shall assume the prime responsibility for monitoring the implementation of the law on protection of state secrets in the city; synthesize difficulties and obstacles in organizing the implementation of the law on protection of state secrets to propose the Ministry of Public Security to handle or advise the City People's Committee to propose competent agencies to handle.
