Based on Article 15 of the Regulations on the Management, Operation, and Exploitation of the National Public Service Portal issued with Decision 31/2021/QD-TTg (Effective from December 9, 2021), the regulations on responsibility for updating and publishing administrative procedure data are as follows:
1. Ministries, agencies, and provincial People's Committees shall update the contents specified in Article 14 of the above Regulations; connect and integrate administrative procedure data on the National Database regarding administrative procedures with the National Electronic Information Portal and the Public Service Portal at the ministry and provincial levels, specifically as follows:
a) Ministries and agencies at the ministerial level shall update the published decisions and administrative procedure contents within the scope of state management functions, the scope of resolution by the ministry or agency as announced and published by the Minister or the head of the agency concerned; online public services provided by the ministry or agency on the National Public Service Portal, and the shared data catalogue specified in Clauses 1, 2, 3, 5, and 6, Article 6 of the above Regulations.
The offices of the ministries and agencies (the leading units responsible for administrative procedure control) shall assist the Minister or the head of the agency in organizing the updating, publishing, or authorizing users for departments, subordinate units; supervise, guide, and inspect the updating at the ministry or agency.
b) Provincial People's Committees shall organize the updating of published decisions and administrative procedure contents as prescribed by laws or detailed regulations in legal documents of the local governments at the provincial or central-affiliated city level; localize administrative procedure data according to the published data catalog of administrative procedures within the jurisdiction of the local governments at the provincial or central-affiliated city level, which have been announced, published, and publicly available on the National Database of Administrative Procedures; online public services provided by the local governments at the provincial or central-affiliated city level, and the shared data catalogue as specified in Clauses 2, 3, 4, and 6, Article 6 of the above Regulations.
The offices of the provincial People's Committees shall assist the provincial People's Committees in organizing the updating, publishing, or authorizing users for departments, agencies; supervise, guide, and inspect the updating.
c) Vietnam Social Security, Social Policy Bank, and Vietnam Development Bank shall update the published decisions and administrative procedures for their work; online public services provided by the agencies on the National Public Service Portal, and the shared data catalogue as specified in Clauses 1, 2, 3, 5, and 6, Article 6 of the above Regulations.
The units in charge of controlling job resolution procedures of Vietnam Social Security, Social Policy Bank, and Vietnam Development Bank shall assist the Director General in organizing the updating, publishing, or authorizing users for subordinate units to update, publish, and supervise, guide, and inspect the updating of those units.
2. The deadline for updating and publishing administrative procedure data for uploading to the National Database of Administrative Procedures shall comply with the provisions of Article 24 of Decree 63/2010/ND-CP dated June 8, 2010, of the Government on administrative procedure control, as amended and supplemented.
The shared data catalogue specified in Clauses 3, 4, and 5, Article 6 of the above Regulations must be updated immediately when the effective legal regulations or decisions of the competent authorities are issued.
3. The Government Office is responsible for guiding, inspecting, and supervising the implementation of the updating regulations in Clauses 1 and 2 of this Article by ministries, agencies, Vietnam Social Security, Social Policy Bank, Vietnam Development Bank, and provincial People's Committees.
