Based on Section 2 of Resolution 152/NQ-CP regulating the proposal to make the Law on Health Insurance (amended) at the specialized legal-making session in November 2021 as follows:

The Government agrees on the necessity, objectives, and viewpoints to amend the Law on Health Insurance. The Ministry of Health shall lead, coordinate with the Ministry of Justice, the Government Office, and relevant agencies to fully absorb the opinions of the Government members, urgently perfect the policy contents towards:

- Fully institutionalize the viewpoints of the 13th Party Congress on social security and Resolution No. 20-NQ/TW dated October 25, 2017 of the 6th Central Executive Committee on enhancing the protection and care of people's health in the new situation. Health insurance policies need to ensure the principles of contribution - enjoyment and risk-sharing, accuracy, and sufficiency in the direction of: diversifying health insurance packages, stratifying appropriately to the economic and social conditions of Vietnam; ensuring social security; promoting the development of health insurance; encouraging and creating conditions for the development of grassroots healthcare system, private healthcare to reduce the burden on upper-level hospitals; enhancing the capacity of people's health care; promoting modernization, applying information technology, unifying technology application; strengthening inspection, examination, supervision scientifically, effectively, and in coordination with the Law on medical examination and treatment.

- Improve policies on the allocation, use, and management of the Health Insurance Fund effectively to develop specific solutions, comprehensively address issues in line with the purpose and content of this policy, ensuring the strictness, transparency of legal regulations, avoiding abuse, negativity, profiteering in policy implementation. Review policies in the Proposal to build the Law, not stipulating the establishment of organizational apparatus, not increasing staffing according to current Law construction requirements.

- Based on the summary of the implementation of the current Law, the Ministry of Health evaluates the impacts meticulously, fully, studies, absorbs the opinions of scientists, experts, and subjects subject to adjustment, has solutions to ensure feasibility, scientificity, and feasibility for the state budget.

Assign the Ministry of Health to coordinate with the Ministry of Justice to complete the Proposal to build the Law in accordance with the provisions of the Law on promulgation of legal normative documents. Assign the Minister of Justice to delegate the Prime Minister, on behalf of the Government, to propose to the Standing Committee of the National Assembly to supplement this Law project to the Law and Ordinance building program in 2022 to submit to the National Assembly at the 4th session of the 15th National Assembly.
