According to Article 33 of the Regulations on the Management, Operation, and Exploitation of the National Public Service Portal issued together with Decision 31/2021/QD-TTg (effective from December 9, 2021), the process of online payment is regulated as follows:
1. Organizations and individuals are required to pay fees, charges, taxes, and other financial obligations (if applicable) when completing administrative procedures or using public services through the online payment function of the National Public Service Portal, in one of the following ways:
a) Conducting the payment on the Ministry-level or Provincial-level Public Service Portal and selecting the integrated online payment system of the National Public Service Portal.
b) Directly making online payments or using online public services, and selecting the online payment system on the National Public Service Portal.
2. Direct online payment on the National Public Service Portal:
a) Organizations and individuals choose the type of payment transaction and provide the required information.
b) Based on the payment information shared by the agency or unit providing the public service and connected to the National Public Service Portal, organizations and individuals follow the payment process as specified in Clause 5 of this Article.
3. Online payment for online dossiers submitted through the National Public Service Portal:
a) Organizations and individuals choose the online public service and follow the instructions to submit the online dossier.
b) Based on the payment request during the online dossier submission process, organizations and individuals select the payment system on the online payment system of the National Public Service Portal.
c) Organizations and individuals follow the payment process as specified in Clause 5 of this Article.
4. Online payment on the Ministry-level or Provincial-level Public Service Portal:
a) Organizations and individuals submit online dossiers or query the processing code of administrative procedures on the Ministry-level or Provincial-level Public Service Portal.
b) Based on the payment request, organizations and individuals select the payment system on the online payment system of the National Public Service Portal.
c) Organizations and individuals follow the payment process as specified in Clause 5 of this Article.
5. Payment process:
a) Organizations and individuals select a commercial bank or payment intermediary organization that is connected and integrated with the online payment system of the National Public Service Portal to make the payment.
b) Documents submitted to the state budget or social insurance, with the digital signature of the commercial bank or payment intermediary organization and the deducted account information of the payer for financial obligations to the state budget or social insurance, are sent to the payer, state budget, social insurance, relevant agencies, and organizations (if applicable). At the same time, the payment status and data are synchronized to the online payment system of the National Public Service Portal immediately after the payer's account is debited.
c) The time for organizations and individuals to complete the payment for taxes, fees, charges, and other financial obligations (if applicable) depends on the type of payment transaction and the amount paid, and is counted from the time when organizations and individuals receive the successful transaction notification from the commercial bank or payment intermediary for the payment and amount paid.
d) Based on the documents submitted to the state budget or social insurance, with the digital signature of the commercial bank or payment intermediary organization and the deducted account information of the payer for financial obligations to the state budget or social insurance, the relevant agency or unit providing the public service proceeds with the next steps in the administrative procedure or public service for the organization or individual.
