Pursuant to Article 1 of the Regulation on functions, tasks, powers and organizational structure of the Department of Home Affairs of Ho Chi Minh City issued together with Decision 31/2022/QD-UBND stipulating positions and the functions of the Department of Home Affairs of Ho Chi Minh City as follows:

1. Department of Home Affairs is a specialized agency under the People's Committee of Ho Chi Minh City (the City People's Committee) advising and assisting the City People's Committee in performing the state management function on: organizational structure; employment positions, civil servant rank structure and civil servant payrolls in state administrative agencies and organizations; job positions, structure of public employees by professional title and number of people working in public non-business units; salaries for cadres, civil servants, public employees and contract workers in agencies, administrative organizations and public non-business units; administrative reform, civil service reform; local government; administrative boundaries; officials and civil servants; cadres and civil servants of communes, wards and townships (collectively referred to as commune level) and those who work part-time at commune, ward or hamlet levels; staff training and education, civil servants, public employees and commune-level cadres and civil servants; associations, non-governmental organizations; records, state archives; religious beliefs; youth; Emulation and Reward.

2. The Department of Home Affairs has legal status, its own seal and account; abide by the direction and management of the organization, staffing and work of the City People's Committee, and at the same time comply with the direction, inspection and professional guidance of the Ministry of Home Affairs.

3. The office of the Department of Home Affairs is located at 86B Le Thanh Ton Street, Ben Nghe Ward, District 1, Ho Chi Minh City.

Pursuant to Clause 1 Article 2 of the Regulation on functions, tasks, powers and organizational structure of the Department of Home Affairs of Ho Chi Minh City issued together with Decision 31/2022/QD-UBND stipulating duties and powers of the Department of Home Affairs of Ho Chi Minh City regarding reporting to the City People's Committee as follows:

1. Submit to the City People's Committee

a) Issue decisions under the authority of the City People's Committee:

Planning, plans, schemes, projects and programs, measures to organize the performance of tasks related to the domestic sector and field in the city.

Decentralize and delegate tasks of state management of domestic sectors and fields to specialized agencies under the City People's Committee; People's Committee of district, city of Thu Duc (collectively referred to as district-level People's Committee).

Specify the functions, tasks, powers and organizational structure of the Department of Home Affairs and of branches and organizations equivalent to branches under the Department of Home Affairs.

Carry out socialization of public non-business service provision activities according to sectors, internal affairs and as decentralized by superior state agencies.

b) Promulgate documents directing and guiding by branches and domains of internal affairs for agencies, organizations and units of the locality in accordance with the Party's regulations, the law and the direction of superior state agencies.

Pursuant to Clause 2 and 3, Article 2 of the Regulation on functions, tasks, powers and organizational structure of the Department of Home Affairs of Ho Chi Minh City issued together with Decision 31/2022/QD-UBND stipulating duties and powers of the Department of Home Affairs of Ho Chi Minh City regarding reporting to the Chairman of the City People's Committee as follows:

2. Submit to the Chairman of the City People's Committee

a) Issue a decision specifying the functions, tasks, powers and organizational structure of the public non-business units under the Department of Home Affairs.

b) The decision on appointment of personnel falls under the competence of the Chairman of the City People's Committee in accordance with the Party's regulations and the law.

3. Organize the implementation of legal documents, plannings, plans, schemes, projects and programs already approved by competent authorities; guide, inspect, inform, propagate, disseminate, educate, and monitor law enforcement in the fields under the assigned state management scope.
