What are regulations on the position and function of the Department for Roads of Vietnam?

Pursuant to Article 1 of the Decision 1218/QĐ-BGTVT in 2022 stipulating the position and function as follows:

1. The Department for Roads of Vietnam is an organization directly under the Ministry of Transport performing the function of advising and assisting the Minister of Transport in state management and organization of law enforcement on road transport nationwide (except for the function assigned to the Viet Nam Expressway Authority); organize the implementation of public services on road transport according to the provisions of law.

2. The Department for Roads of Vietnam has legal status, has its own seal in the shape of the national emblem, has its own account at the State Treasury, and is headquartered in Hanoi.

3. Cục Đường bộ Việt Nam has a transaction name in English: The Department for Roads of Vietnam (DRVN for short).

What are duties and powers of the Department for Roads of Vietnam?

Pursuant to Article 2 of the Decision 1218/QĐ-BGTVT in 2022 stipulating duties and powers as follows:

1. Develop for the Minister of Transport (hereinafter referred to as the Minister) to submit to competent authorities for promulgation or promulgate according to his/her competence (except for tasks assigned to the Vietnam Expressway Authority):

a) Legal documents, mechanisms, policies and other documents on road transport;

b) Strategies, master plans, medium-term and annual plans, programs and projects on development of road transport nationwide.

2. Formulate national standards, national technical regulations and economic-technical norms specialized in road transport (except for expressways) and submit them to the Minister for promulgation according to his/her competence or request the competent agencies to appraise and announce; organize the elaboration and publication of specialized facility standards.

3. Organize the implementation and inspect the implementation of legal documents, standards, national technical regulations, mechanisms, policies, strategies, national programs, master plans, plans, schemes and projects on road transport (except for expressways).

4. Organize the propagation and dissemination of the law on road transport (except for expressways).

5. Regarding construction investment management, management, exploitation, use, maintenance and protection of road traffic infrastructure:

a) Develop and submit to the Minister for promulgation or the Minister to submit to competent authorities for promulgation regulations, mechanisms for creating capital and resources for the construction, management, exploitation, use and maintenance of infrastructures; road traffic floor (except for the task assigned to the Vietnam Expressway Administration);

b) Develop and submit to the Minister: to decide on classification and adjustment of the national highway system; regulations on connection to national highways, assessment of road traffic safety, load capacity, road limit gauge, announcement of load capacity, gauge limit of national highway, road signs, vehicle speed, placing speed signs, organization and operation of vehicle load testing stations;

c) Exercise the authority to decide on investment, tasks of investors, and tasks of specialized agencies in charge of construction of road construction investment projects (except for expressways) as assigned or decentralized, authorized by the Minister;

d) Traffic organization on the national highway system; organize the management, exploitation, use and maintenance of traffic infrastructure on national highways;

dd) Guide the management, maintenance, exploitation and use of road infrastructure; summarizing the development of road systems nationwide;

e) Set prices of public products and services in the management, exploitation, use and maintenance of national highway infrastructure;

g) Coordinate with relevant agencies and local authorities to protect traffic infrastructure and road safety corridors;

h) Exercise the rights and obligations of the agency assigned to manage infrastructure assets; organize the assignment of tasks, place orders and bidding for the provision of public products and services in accordance with law;

i) Perform the tasks of competent agencies, contracting agencies, and specialized construction agencies for road construction investment projects under the mode of public-private partnership approved by the Ministry of Transport is a competent agency according to the provisions of law and decentralized and authorized by the Minister (except for the tasks assigned to the Vietnam Expressway Authority);

k) Assume the prime responsibility for, and coordinate with the Vietnam Expressway Authority in organizing management and maintenance; directly organize the operation of expressways invested with state budget capital in accordance with law (except for the tasks assigned to the Vietnam Expressway Authority);

l) Perform the tasks of the investment decision-making agency, the agency signing the operation contract, and the specialized agency affiliated to the Ministry of Transport with respect to the business, service and operation works of national highways, socialization projects according to assignment, decentralization and authorization (except for the tasks assigned to the Vietnam Expressway Authority).

6. Regarding the management of vehicles and drivers of road motorized vehicles (except for vehicles and drivers of road motor vehicles serving national defense and security purposes):

a) Formulate and submit to the Minister for submission to the competent authority a proposal for the conclusion or accession to international treaties on road motor vehicle licenses; organize the issuance of international driving licenses according to international treaties and agreements on driving licenses as decentralized by the Minister;

b) Formulate and submit to the Minister regulations on training, testing, granting, renewal, extension and revocation of driving licenses for road motor vehicle drivers; regulate granting, revoking registration and number plates of special-use motorbikes participating in road traffic; stipulate the granting of certificates of training in road traffic law knowledge to drivers of special-use motorbikes participating in traffic; guide the implementation organization;

c) Formulate and submit to the Minister for promulgation national technical regulations on the driving test center and equipment serving the management of training, testing and issuance of driver's licenses; organize the implementation, guidance, examination and verification of the implementation of standards and regulations and the granting of certificates of road motor vehicle driving testing centers that are eligible to operate in accordance with law;

d) Securely design, print, issue, guide and manage the use of driving licenses, certificates of training in road traffic law knowledge for drivers of special-use motorbikes nationwide;

dd) Manage the training, testing, granting of road motor vehicle driving licenses and certificates of training in legal knowledge for drivers of special-use motorcycles participating in road traffic as assigned by the Minister;

e) Organize the registration of special-use motorcycles participating in road traffic;

g) Coordinate in formulating standards and technical regulations of road transport vehicles and equipment;

h) Organize special circulation permits for overloaded vehicles, oversize limits of roads, crawler vehicles; grant permits to vehicles and forces accompanying road vehicles to carry out search and rescue in accordance with law.

7. Regarding road transport management:

a) Formulate and submit to the Minister regulations on organization and management of road transport, road transport support services and approve international cooperation programs and plans on road transport;

b) Formulate and submit to the Minister for submission to the agency competent to ratify the proposal for the conclusion or accession to international treaties on roads; organize the licensing of international road transport according to international treaties and agreements on road transport according to the decentralization of the Minister;

c) Road transport management and road transport support services as prescribed by law; manage passenger transport routes by car as decentralized by the Minister;

d) Guide and inspect the implementation of road transport business conditions and regulations on road transport support services; guide the organization of economic development of collectives and cooperatives in road transport;

dd) Coordinate in implementing and implementing contents on anti-terrorism and epidemic prevention in road transport.

8. Regarding road traffic safety:

a) Develop and submit to the Minister projects and solutions to ensure road traffic order and safety; guide and inspect the implementation of measures to ensure road traffic safety according to the provisions of law;

b) Organize the performance of prevention, combat and response to incidents and natural disasters and coordinate search and rescue in road traffic according to the decentralization of the Minister;

c) Guide, inspect and coordinate in the implementation of load control of road transport vehicles nationwide;

d) Organize the handling of black spots and potential traffic accidents, assess traffic safety in the management and maintenance of the national highway system in use;

dd) Organize inspection of occupational safety and health; organize the investigation of occupational accidents occurring on land means of transport according to the provisions of law;

e) Coordinate with relevant units in organizing the implementation of fire prevention and fighting work for the national highway system being operated in accordance with law.

9. Regarding environmental protection in road transport (except for expressways):

a) Organize and submit to competent agencies for appraisal and approval the strategic environmental assessment, environmental impact assessment, environmental permits, environmental registration for plannings, programs, projects on development of road traffic infrastructure according to the provisions of law;

b) Organize the implementation of programs, projects, schemes, master plans and plans on environmental protection in the construction, management and maintenance of road traffic infrastructure under its management.

10. Carry out international cooperation in road transport (except for expressways) according to the decentralization and authorization of the Minister.

11. Research and apply scientific advances and technology transfer, build and implement programs and projects on information technology application, implement digital transformation in the field of road transport (except for expressways); build and manage databases, assure information services in service of specialized state management.

12. Perform specialized inspection tasks, receive citizens, settle complaints and denunciations, prevent and combat corruption, and sanction administrative violations in accordance with law.

13. Develop and implement the program of administrative reform and application of information technology in the activities of the Road Administration of Vietnam according to the objectives and contents of the administrative reform program of the State and the Ministry of Transport.

14. Manage the organizational apparatus, civil servants, public employees and employees according to the provisions of law and decentralization of the Minister; implement regimes, policies, emulation, commendation, discipline, professional training and retraining for civil servants, public employees and employees according to the provisions of law and decentralization of the Minister.

15. Manage assigned finance, assets and other resources in accordance with law and decentralization of the Minister.

16. Perform other tasks and exercise other powers assigned by the Minister and in accordance with law.

Pursuant to Article 3 of the Decision 1218/QĐ-BGTVT in 2022 stipulating organizational structure as follows:

3. Planning - Investment Department.

4. Finance Department.

5. Department of management and maintenance of transport infrastructure.

6. Department of Management of transport, vehicles and drivers.

7. Department of Science, Technology, Environment and International Cooperation.

8. Road Construction Investment Management Sub-Department.

9. Road Management Zone I.

10. Road Management Zone II.

11. Road Management Zone III.

12. Road Management Zone IV.

13. College of Road Transport.

14. Road Engineering Center.

Organizations specified in Clauses 1 to 12 of this Article are units that assist the Director in performing the state management function; organizations specified in Clauses 13 and 14 of this Article are public non-business units directly under the Department.

The Director of the Department for Roads of Vietnam stipulates the functions, tasks and powers of the organizations specified in Clauses 1 to 7 and stipulates the functions, tasks, powers and organizational structure of the organizations specified in Clause 14 of this Article.

What are regulations on the leaders of the Department for Roads of Vietnam?

Pursuant to Article 4 of the Decision 1218/QĐ-BGTVT in 2022 stipulating the leaders as follows:

1. The Department for Roads of Vietnam has a Director and Deputy Directors.

The number of Deputy Directors shall comply with the provisions of law and the Ministry of Transport.

The Director of the Department for Roads of Vietnam shall be appointed, relieved of duty, rotated and mobilized by the Minister in accordance with law.

The Deputy Director of the Department for Roads of Vietnam shall be appointed, relieved of duty, rotated and transferred by the Minister at the request of the Director of the Department for Roads of Vietnam.

2. The Director of the Department for Roads of Vietnam is responsible before the Minister and before the law for all activities of the Department. The Deputy Director of the Department for Roads of Vietnam is responsible to the Director and to the law for the field of work assigned to him.

3. The Director of the Department for Roads of Vietnam shall appoint and dismiss the leading and managerial positions under the Department according to the provisions of law and the decentralization of the Minister.
