What are regulations on the decision on the issue of war and peace at the National Assembly session in Vietnam?

Pursuant to Article 54 of the National Assembly's Session Regulations issued together with the Resolution 71/2022/QH15 (effective from March 15, 2023) stipulating the decision on the issue of war and peace at the National Assembly session in Vietnam as follows:

1. A dossier to be submitted to the National Assembly for decision on war and peace issues includes:

a) A report of the National Defense and Security Council requesting the National Assembly to decide on the issue of war and peace;

b) The draft resolution;

c) Verification report of the National Assembly's Committee on Defense and Security;

d) Other documents (if any).

2. The National Assembly shall decide on war and peace issues in the following order:

a) The President presents the report;

b) The representative of the National Assembly's National Defense and Security Committee presents the verification report;

c) Before discussing at the plenary session of the National Assembly, the National Assembly deputies may discuss at the National Assembly Delegation or National Assembly Delegation;

d) During the discussion at the plenary session of the National Assembly, the President explains the opinions of the National Assembly deputies on relevant issues;

dd) The National Assembly Standing Committee shall coordinate with the State President in directing and organizing the study, explanation, reception and revision of the draft resolution;

e) The Standing Committee of the National Assembly shall report to the National Assembly on the explanation and absorption of opinions of the National Assembly deputies and the revision of the draft resolution;

g) The National Assembly votes to approve the draft resolution.

What are regulations on the decision to shorten or extend the term of the National Assembly, the term of the People's Council in Vietnam?

Pursuant to Article 55 of the National Assembly's Session Regulations issued together with the Resolution 71/2022/QH15 (effective from March 15, 2023) stipulating the decision to shorten or extend the term of the National Assembly, the term of the People's Council in Vietnam as follows:

1. A dossier to be submitted to the National Assembly for decision on shortening or extending the term of the National Assembly and the term of the People's Council includes:

a) A report of the Standing Committee of the National Assembly requesting the National Assembly to decide on shortening or extending the term of the National Assembly or the term of the People's Council;

b) The draft resolution;

c) Other documents (if any).

2. The National Assembly shall decide to shorten or prolong the term of the National Assembly and the term of the People's Council in the following order:

a) The representative of the Standing Committee of the National Assembly presents the report;

b) Before discussing at the plenary session of the National Assembly, the National Assembly deputies may discuss at the National Assembly Delegation or the National Assembly Delegation;

c) The Standing Committee of the National Assembly shall report to the National Assembly on the explanation and absorption of opinions of the National Assembly deputies and the revision of the draft resolution;

d) The National Assembly votes to approve the draft resolution.

What are regulations on decision on the national election date for the election of deputies to the National Assembly, during the mid-term period in Vietnam?

Pursuant to Article 56 of the National Assembly's Session Regulations issued together with the Resolution 71/2022/QH15 (effective from March 15, 2023) stipulating the decision on the national election date for the election of deputies to the National Assembly, during the mid-term period in Vietnam as follows:

1. Dossier to submit to the National Assembly for decision on the national election date for the election of deputies to the National Assembly and the election of deputies to the People's Councils at all levels; decide on the additional election of National Assembly deputies during the mid-term, including:

a) A report of the Standing Committee of the National Assembly requesting the National Assembly to decide on the national election date for the election of deputies to the National Assembly and the election of deputies to the People's Councils at all levels; decide on the additional election of National Assembly deputies during the midterms;

b) The draft resolution;

c) Other documents (if any).

2. The National Assembly shall decide on the national election date for the election of deputies to the National Assembly and the election of deputies to the People's Councils at all levels in the following order:

a) The representative of the Standing Committee of the National Assembly presents the report;

b) The National Assembly discusses and votes to approve the draft resolution.

3. The National Assembly shall decide on the additional election of National Assembly deputies in the following order:

a) The National Assembly shall establish an additional Election Council according to the order prescribed in Articles 36, 37 and 41 of the Regulations of the National Assembly session;

b) The National Assembly shall decide on the date of additional election of National Assembly deputies according to the order prescribed in Clause 2 of this Article.
