Based on Article 5 of the Regulation on Recruitment, Job Transfer, Job Promotion of Officials and Civil Servants, and Work of Officials and Employees of the Ministry of Industry and Trade issued together with Decision 222/QD-BCT in 2022, the provisions regarding the competent authority for recruiting civil servants are as follows:

1. The Ministry of Industry and Trade recruits civil servants for the administrative agencies under the Ministry (excluding civil servants of local Market Management organizations).

2. The General Department of Market Management recruits civil servants for the local Market Management organizations after obtaining the consolidated opinions of the Ministry of Industry and Trade.

Who are the members of the Civil Servant Recruitment Council of the Ministry of Industry and Trade in Vietnam?

Based on Article 6 of the Regulation on Recruitment, Job Transfer, Job Promotion of Officials and Civil Servants, and Work of Officials and Employees of the Ministry of Industry and Trade issued together with Decision 222/QD-BCT in 2022, the provisions regarding the Civil Service Recruitment Council are as follows:

1. The Minister or the General Department Director decides to establish the Civil Service Recruitment Council to organize the recruitment process according to the hierarchy. The Recruitment Council consists of 5 or 7 members, including:

a) The Chairman of the Council is the Minister or one of the Deputy Ministers (for recruitment organized by the Ministry); the General Department Director or one of the Deputy Directors (for recruitment organized by the General Department).

b) The Vice Chairman of the Council is the representative of the leadership of the Personnel Organization Department or the advisory agency responsible for personnel work of the General Department.

c) The Council Member cum Secretary is a civil servant from the Personnel Organization Department or the advisory agency responsible for personnel work of the General Department.

d) Other members are representatives of the leadership of specialized units or relevant professional units related to the recruitment process, as decided by the Minister or the General Department Director.

2. The Recruitment Council works collectively and makes decisions based on majority votes. In case of a tie vote, the decision shall follow the opinion of the Chairman of the Recruitment Council. The Recruitment Council has the following tasks and powers:

a) Establishing supporting units: the Registration Inspection Board, the Exam Board, the Exam Supervision Board, the Authentication Board, the Exam Grading Board, the Review Grading Board (if applicable), and the Interview Supervision Inspection Board for the implementation of the second round interview if necessary. If needed, the Chairman of the Recruitment Council may establish a Secretary Team to assist with the work.

b) Organizing the collection of application fees and using the fees as regulated.

c) Inspecting the registration forms, organizing the exams, grading the exams, and reviewing the grades according to the regulations.

d) Reporting to the Minister or the General Department Director for the decision on recognizing the recruitment and selection results.

dd) Handling complaints and denunciations during the recruitment and selection process.

e) The Recruitment Council self-dissolves after completing its tasks.

3. Individuals who have relationships such as parents, siblings, spouses, or children of the applicants or the spouses of the applicants, those who are under disciplinary processing or implementing disciplinary decisions cannot be appointed as members of the Recruitment Council or members of the supporting units of the Recruitment Council.
