1. The Department of Science and Technology of Ho Chi Minh City (hereinafter referred to as the Department) is a specialized agency under the People's Committee of Ho Chi Minh City (hereinafter referred to as the City People's Committee), perform the function of advising and assisting the City People's Committee in the state management of science and technology, including: scientific research activities, technological development and innovation; develop scientific and technological potentials; standards, measurement, quality; Intellectual Property; radiation and radioisotope applications; radiation and nuclear safety; manage and organize the implementation of public non-business services in the areas within the scope of functions of the Department in the city according to the provisions of law.

2. The Department has legal status, its own seal and account as prescribed by law; abide by the direction and management of the organization and operation of the City People's Committee according to its competence, and at the same time comply with the direction, inspection and professional guidance of the Ministry of Science and Technology.

Pursuant to Clause 1 Article 3 of the Regulation of the functions, tasks, powers and organizational structure of the Department of Science and Technology of Ho Chi Minh City issued together with the Decision 38/2022/QD-UBND of the People's Committee of Ho Chi Minh City stipulating as follows:

1. Reporting to the City People's Committee:

a) Draft decision related to the field of science, technology and innovation under its management and other documents as assigned by the City People's Committee;

b) Draft development plan in the fields of science, technology and innovation; draft programs, schemes, projects, measures to organize the performance of tasks in the fields of science, technology and innovation in the city under its management;

c) The draft decision on decentralization and authorization of state management tasks in the fields of science, technology and innovation to the Department, the People's Committee of the district, city under the city;

d) The draft decision specifying the functions, tasks, powers and organizational structure of the Department; the draft decision stipulating the functions, tasks, powers and organizational structure of the branch and public non-business units under the Department; draft decision on establishment and regulations on organization and operation of the City's Science and Technology Development Fund in accordance with law;

dd) Draft decision on implementation of socialization of public non-business service provision activities in the field of science and technology under the competence of the City People's Committee and as decentralized by superior state agencies.
