According to Article 3 of Circular 12/2020/TT-BGDĐT, the position and functions of the Department of Education and Training under the People's Committee of the district are stipulated as follows:

1. The Department of Education and Training is a specialized agency under the People's Committee of the district, performing the function of advising and assisting the People's Committee of the district in state management of education at the locality in accordance with the law and performing the tasks and powers under the delegation of the People's Committee of the district, the Chairman of the People's Committee of the district.

2. The Department of Education and Training has legal personality, has its own seal and account in accordance with the law; is subject to the leadership, management of the organization, position of employment, personnel and work of the People's Committee of the district, and at the same time is subject to the direction, guidance, inspection of professional, technical and other regulations of the Department of Education and Training.

What are tasks and powers of the Department of Education and Training under the People's Committee of the district in Vietnam?

According to Article 4 of Circular 12/2020/TT-BGDĐT, the position and functions of the Department of Education and Training under the People's Committee of the district are stipulated as follows:

The Department of Education and Training performs the tasks and powers stipulated in Article 13 of Decree No. 127/2018/NĐ-CP dated September 21, 2018 of the Government stipulating the responsibilities of state management of education, Decree No. 46/2017/NĐ-CP dated April 21, 2017 of the Government stipulating the conditions for investment and operation in the field of education, Decree No. 135/2018/NĐ-CP dated October 4, 2018 of the Government amending and supplementing some articles of Decree No. 46/2017/NĐ-CP, the relevant laws and regulations and performs the following tasks and powers:

1. Coordinate with relevant agencies to submit to the People's Committee of the district:

a) Issue guiding documents, organize the implementation of legal documents on education; plans, programs, projects for the development of early childhood education, primary education, and secondary education in the locality after being approved by the competent authority; the implementation plan for the Project to renew the curriculum, textbooks for general education in the district in accordance with the plan of the province; legal documents on education under the authority;

b) Approve the Project to reorganize, reorganize preschool, primary, and secondary schools in the locality in accordance with the actual conditions of the locality, meeting the conditions to ensure the quality of education.

2. Coordinate with relevant agencies to implement the state management functions of the People's Committee of the district on education according to the Government's delegation.

3. Implement the recruitment, use, and training of teachers, educational management staff, and employees in public educational institutions directly under the People's Committee of the district in accordance with the law when authorized.

4. Manage teaching and educational activities in and outside schools; direct the implementation of moral education, lifestyle, and school safety activities; organize the implementation of the plan to implement the Project to renew the curriculum, textbooks for general education; implement and direct the implementation of educational communication work in the locality.

5. Regularly update information about the team of teachers and educational management staff under the management into the educational sector database. Fully and timely implement the annual periodic reporting regime on public disclosure of the education sector of the locality under the management to the People's Committee of the district and the Department of Education and Training in accordance with the regulations.
