What are regulations on organizing work with the complainant to collect information, documents, and evidence related to the content of the complaint of the People's Public Security of Vietnam?
Pursuant to Article 15 of the Circular 129/2020/TT-BCA stipulating regulations on organizing work with the complainant to collect information, documents, and evidence related to the content of the complaint as follows:
1. The investigation team sends an invitation letter or other forms of contact, selects a convenient location to meet with the complainant in person; requests that the complainant provide information, documents, and evidence that the complainant has obtained to clarify the content of the complaint. The complainant is responsible for presenting the content of the complaint honestly, cooperating, and providing information and documents that they have obtained.
2. The process of working with the complainant must ensure the confidentiality of the meeting, and must not allow those who are not responsible to know about the location or content of the meeting (except in cases where the complainant does not need to keep the information confidential). The content of the meeting with the complainant must be recorded in a minutes of meeting according to the prescribed form, with the signatures of the complainant and the person presiding over the meeting; the minutes of meeting must be prepared in at least two copies, one copy is given to the complainant (if the complainant requests) and one copy is kept in the file for handling the complaint. In case the complainant does not sign the minutes of meeting, the person presiding over the meeting and other members of the investigation team participating in the meeting sign the minutes of meeting and clearly state the reason why the complainant does not sign.
3. In case it is not possible to meet with the complainant in person due to objective reasons, the person handling the complaint, the person who issued the decision to establish the investigation team, or the head of the investigation team shall issue a document requesting the complainant to provide information, documents, and evidence to clarify the content of the complaint.

What are regulations on working with the accused to collect information, documents, and evidence related to the content of the complaint of the People's Public Security of Vietnam?
Pursuant to Article 16 of the Circular 129/2020/TT-BCA stipulating regulations on working with the accused to collect information, documents, and evidence related to the content of the complaint as follows:
1. The verification team must work directly with the accused; Request a written explanation of the denounced contents, provide information, documents and evidence related to the denunciation and explanation content. The content of working with the accused person must be recorded in writing according to the prescribed form and signed by the accused person (or representative of the accused agency or unit) and the person in charge of the work. The content of working shall be made into 02 copies, one copy is delivered to the accused person (if the accused person requests) and one copy is kept in the denunciation settlement file.
2. In case the accused person's explanation is unclear; If the information, documents, and evidence provided by the accused person is not complete, the Verification Team requests the accused person to continue to explain and provide information, documents, and evidence on unclear issues.

Pursuant to Article 17 of the Circular 129/2020/TT-BCA stipulating regulations on collecting and processing information, documents, and evidence related to the content of the complaint as follows:
1. The person handling the complaint, the person who issued the decision to establish the investigation team, or the head of the investigation team shall issue a document requesting other agencies, organizations, units, and individuals to provide information, documents, and evidence related to the content of the complaint.
2. In case it is necessary, the investigation team shall meet directly with other agencies, organizations, units, and individuals to collect information, documents, and evidence related to the content of the complaint. The content of the meeting must be recorded in a minutes of meeting according to the prescribed form, with the signatures of the representative of the investigation team, the representative of the agency, organization, unit, or individual providing information, documents, and evidence, and the minutes of meeting must be prepared in two copies, one copy is given to the agency, organization, unit, or individual providing information, documents, and evidence (if requested) and one copy is kept in the file for handling the complaint.
