Based on Article 2 of the Recruitment and Admissions Regulations for officials and public employees, exams for promotion of officials, or exams or admissions for professional title promotion of public employees, issued together with Circular 6/2020/TT-BNV, the regulations on handling violations for candidates are as follows:

1. Reprimand:

The exam room supervisor prepares a record and publicly announces it in the exam room, applying to candidates who commit one of the following violations:

a) Intentionally sitting in the wrong seat number assigned to them;

b) Exchanging information with other candidates and failing to comply after being warned;

c) Bringing mobile phones, recording devices, cameras, computers, technical devices for information transmission, data backup devices, or any related documents and materials into the exam room (except when the exam paper specifies otherwise).

2. Warning:

The exam room supervisor prepares a record and publicly announces it in the exam room, applying to candidates who commit one of the following violations:

a) Exchanging answers or drafts with other candidates;

b) Allowing other candidates to copy their answers or copying answers from other candidates;

c) Using materials, mobile phones, recording devices, cameras, computers, or any technical devices for information transmission, data backup devices, or other information storage and transmission devices in the exam room (except when the exam paper specifies otherwise).

3. Suspension from the exam:

The head of the exam board decides to suspend a candidate from the exam if the candidate has been reprimanded but intentionally violates the exam regulations or intentionally causes safety issues or disruptions in the exam room. The suspension is publicly announced in the exam room.

4. Invalidating the exam results:

Based on the report from the Chairman of the Council, the head of the recruiting agency authorized to organize the recruitment or promotion exams invalidates the exam results for candidates who commit one of the following violations:

a) Writing or drawing irrelevant content on the exam paper;

b) Swapping or taking the exam on behalf of others or being suspended from the exam.

5. Deducting exam scores:

a) Candidates who receive a reprimand in a specific part, exam, or subject will have 25% of the total correct answers or 25% of the total score deducted in that part, exam, or subject.

b) Candidates who receive a warning in a specific part, exam, or subject will have 50% of the total correct answers or 50% of the total score deducted in that part, exam, or subject.

c) When calculating and grading, based on the violation record prepared by the exam room supervisor, the Secretary of the Council reports to the Chairman of the Council for consideration and decision on score deduction according to the provisions in points a and b of this section.

6. Giving a score of zero (0) for paper-based or written exams:

The head of the grading board decides to give a score of zero (0) based on a written report from the member of the grading board in the following cases:

a) The exam, paper, or subject has two or more different answers.

b) The exam, paper, or subject has two or more different handwriting styles.

c) The exam, paper, or subject is written with two or more different ink colors or using ink colors not specified in Article 6 of these regulations, except when confirmed by the exam room supervisor and the head of the exam board.

d) The exam, paper, or subject is written on a draft paper or paper not provided by the exam room supervisor.

7. Candidates who violate the regulations must have a violation record prepared, signed by both the exam room supervisor and the candidate. After preparing the record and publicly announcing it in the exam room, the exam room supervisor must immediately report it to the head of the exam board.

If a candidate refuses to sign the violation record, the exam room supervisor invites two nearby candidates to confirm the incident. If one or both of the invited candidates refuse to sign the confirmation, the exam room supervisor still prepares the violation record and reports it to the head of the exam board for consideration and decision.

8. Candidates who intentionally cause safety issues or disruptions in the exam room, in addition to being suspended and having their exam results invalidated, may also be subject to legal consequences depending on the nature and severity of the violation.

9. Candidates who are officials, or public employees who are suspended from the exam or have their exam results invalidated, will be subject to disciplinary actions according to the laws and regulations regarding officials, and public employees, as determined by the head of the managing authority.
