Pursuatn to Article 42 of the National Assembly's Session Regulations issued together with the Resolution 71/2022/QH15 (effective from March 15, 2023) stipulating election of Head of National Assembly Delegation and Deputy Head of National Assembly Delegation at the first session in Vietnam as follows:

The National Assembly delegation shall elect the Head and Deputy Head of the National Assembly delegation right after the preparatory meeting according to the following order and procedures:

1. The convenor appointed by the Standing Committee of the National Assembly shall preside over the meeting of the National Assembly delegation, appoint a secretary to record the minutes, and notify the competent authorities of opinions on the expected personnel. Nominated as Head of Delegation and Deputy Head of the National Assembly Delegation. In case the convenor in his absence is unable to preside, he shall authorize a member of the National Assembly Delegation to perform the convenor's duties;

2. National Assembly deputies have the right to nominate or nominate themselves to elect the Head of Delegation and Deputy Head of the National Assembly Delegation;

3. The National Assembly deputies discuss and vote on the list of proposals to elect the Head of the Delegation and Deputy Head of the National Assembly Delegation by show of hands;

4. The National Assembly deputies elect the Vote Counting Team by show of hands;

5. The National Assembly deputies elect the Head and Deputy Head of the National Assembly delegation by secret ballot. If the personnel reach more than half of the total number of deputies of the National Assembly Delegation with the approval, they shall be elected as Head of the Delegation and Deputy Head of the National Assembly Delegation;

6. The vote counting team reports the vote counting results and voting results;

7. The Head of the National Assembly Delegation and the Deputy Head of the National Assembly Delegation shall perform their tasks and exercise their powers immediately after being elected;

8. The chairperson of the meeting completes the dossier and sends it to the National Assembly Standing Committee for approval of the Head and Deputy Heads of the National Assembly delegation, including the report, meeting minutes of the National Assembly delegation, and minutes of vote counting according to the form. prescribed by the Standing Committee of the National Assembly.

Pursuatn to Article 43 of the National Assembly's Session Regulations issued together with the Resolution 71/2022/QH15 (effective from March 15, 2023) stipulating procedures for dismissal from office, relief from office, approval of request for relief from office or dismissal of a person holding a position elected or approved by the National Assembly in Vietnam as follows:

1. Except for the case specified in Clause 2 of this Article, the National Assembly shall relieve or remove from office or approve the request for relief from duty or dismissal of a person holding a position elected or approved by the National Assembly in the following order:

a) Competent agencies or persons recommend to the National Assembly to elect or approve a request for appointment of a person holding a position and submit it to the National Assembly for dismissal or dismissal or approval of such request;

b) The National Assembly deputies discuss at the National Assembly Delegation; The President of the National Assembly may meet with the Heads of the National Assembly Delegation to discuss related issues;

c) A representative of an agency or a competent person shall report to the National Assembly on the explanation and reception of opinions of the National Assembly deputies at the National Assembly Delegation;

c) The National Assembly establishes a vote counting committee;

d) The National Assembly approves the request for dismissal by secret ballot;

dd) The Vote Counting Committee shall report on the vote counting and voting results;

e) The National Assembly Standing Committee shall submit to the National Assembly a draft resolution approving the request for dismissal of the Vice Chairman of the National Defense and Security Council and a member of the National Defense and Security Council;

g) The National Assembly discusses the draft resolution;

h) The National Assembly Standing Committee shall report to the National Assembly on the explanation and absorption of opinions of the National Assembly deputies and the revision of the draft resolution;

i) The National Assembly votes to approve the draft resolution.

What are procedures for decision to stop performing the duties of a National Assembly deputy in Vietnam?

Pursuatn to Article 44 of the National Assembly's Session Regulations issued together with the Resolution 71/2022/QH15 (effective from March 15, 2023) stipulating procedures for decision to stop performing the duties of a National Assembly deputy in Vietnam as follows:

1. The National Assembly Standing Committee shall submit to the National Assembly for dismissal from the duties of National Assembly deputies.

2. The National Assembly discuss on the issues. Before the National Assembly deliberations, the National Assembly deputies who request to resign from their duties as National Assembly deputies have the right to express their opinions.

3. The National Assembly establishes a vote counting committee.

4. The National Assembly shall terminate the duties of a National Assembly deputy by secret ballot.

5. The Vote Counting Board shall report on the vote counting and voting results.

6. The National Assembly Standing Committee shall submit to the National Assembly a draft resolution on dismissal from the duties of National Assembly deputies.

7. The National Assembly discussed.

8. The National Assembly Standing Committee shall report to the National Assembly on the explanation and absorption of opinions of the National Assembly deputies and the revision of the draft resolution.

9. The National Assembly votes to approve the draft resolution.
