4. About the organization of the apparatus
a) Advise and assist the City People's Committee:
Submitting to the City People's Council for consideration and decision the establishment, reorganization and dissolution of specialized agencies under the City People's Committee.
Specific instructions on the order and procedures for establishment, reorganization and dissolution of public non-business units under the City People's Committee.
Direct and guide the district-level People's Committees to specify the functions, tasks, powers and organization of the Internal Affairs Division of the district-level People's Committees.
Direct agencies, organizations and units to perform the state management of non-public non-business units in the locality in accordance with law.
b) Appraise draft documents and submit them to the City People's Committee and the City People's Committee Chairman:
Specifying the functions, tasks, powers and organizational structure of administrative agencies and public non-business units under the decision-making competence of the City People's Committee and the Chairman of the City People's Committee.
The establishment, reorganization and dissolution of administrative organizations, public non-business units and management councils in public non-business units fall under the decision-making competence of the City People's Committee (except for cases where the law does not apply other specialized regulations on appraisal agencies).
Establishing, consolidating, merging and dissolving an interdisciplinary coordination organization under the decision-making authority of the Chairman of the City People's Committee in accordance with law.
c) Appraise, guide, monitor and inspect the classification and ranking of local public non-business units according to the provisions of law and the decentralization of management of the City People's Committee.
d) Cooperate with specialized agencies at the same level in submitting to the City People's Committee for specific instructions on the functions, tasks, powers and organization of other specialized agencies of the People's Committee of the district level.

5. Regarding job positions, civil servant payrolls and civil servant rank structure
a) Appraisal of job position schemes, job position adjustment schemes and civil servant rank structure of agencies and organizations under the management of the City People's Committee; meeting , submit to the City People's Committee for decision .
b) Advise and assist the City People's Committee :
Appraise, summarize and plan the annual payroll of civil servants or adjust the payroll of civil servants under the City People's Council, the City People's Committee, the People's Councils of districts and cities under the City, district-level People's Committees to send them to the Ministry of Home Affairs in accordance with law.
Submit to the City People's Council for decision the payroll of civil servants in the agencies of the City People's Council, the City People's Committee, the People's Council of the district, the city under the city, the district-level People's Committee within the period. total number of civil servants assigned by competent authorities; assist the City People's Committee in implementation after it is decided by the City People's Council.

In Clause 6, Article 2 of the Regulations on functions, tasks, powers and organizational structure of the Department of Home Affairs of Ho Chi Minh City, issued together with Decision 31/2022/QD-UBND of Ho Chi Minh City stipulating employment positions, structure of public employees by professional title and number of people working in public non-business units are as follows:
6. Regarding job positions, structure of public employees by professional title and number of people working in public non-business units
a) Appraisal of project of working position, project of adjustment of job position and structure of public employees according to professional title of public non-business units that cover part of recurrent expenditures and public administrative units; established by the state budget to ensure recurrent expenditures (collectively referred to as public non-business units that have not yet covered their own recurrent expenditures) under the management of the City People's Committee. Submitting to the City People's Committee for approval the employment positions and structure of public employees according to professional titles of public non-business units that have not yet managed to cover recurrent expenditures under their management.
b) Advise and assist the City People's Committee:
Appraisal of the number of people working with salaries from the state budget and the number of people working with salaries from non-business revenues (if any) of public non-business units that have not yet covered their own recurrent expenditures management of the City People's Committee; synthesize and submit to the City People's Committee the plan on the number of people working in public non-business units that have not yet been able to cover their own recurrent expenditures in the locality and submit it to the Ministry of Home Affairs for appraisal.
Submitting to the City People's Council for approval the total number of people working with salaries from the state budget in public non-business units that have not yet been able to self-finance recurrent expenditures under their management in the total number of employees who receive salaries from the state budget have been appraised by the Ministry of Home Affairs.
To decide to assign and adjust the number of people working with salaries from the state budget for each public non-business unit that has not yet managed to cover recurrent expenditures under its management out of the total number of employees approved by the City People's Council.
To decide on the number of people working for salaries from non-business revenues, for each public non-business unit, which covers a portion of recurrent expenditures under its management as prescribed by law.
To guide and inspect the implementation of regulations on employment positions, the structure of public employees by professional titles and the number of people working in public non-business units that self-finance recurrent expenditures and public service units. Public enterprises can self-finance their own recurrent and investment expenditures under their management.
Directing agencies, organizations and units to implement the autonomy mechanism in performing tasks, organizational structure, employment positions, number of people working for public non-business units within the scope of their respective jurisdictions.
c) Summary of job positions, structure of public employees by professional title and number of people working in public non-business units according to the degree of financial autonomy (which is guaranteed by the state budget for recurrent expenditures); partially secure recurrent expenditures; self-finance recurrent expenditures; self-finance recurrent expenditures and investment expenditures) within the management scope of the City, submit to the City People's Committee to submit to the Ministry of Home Affairs according to regulations under the law.
