What are regulations on consolidation of legal documents of the Ministry of Transport in Vietnam?
Pursuant to Article 39 of Circular 26/2022/TT-BGTVT (effective from January 1, 2023) stipulating the consolidation of legal documents of the Ministry of Transport as follows:
1. The Legal Department organizes the consolidation of documents and submits them to the Minister for signature to authenticate the consolidation document.
2. No later than 01 working day after the Minister signs and promulgates the circular amending and supplementing, the consulting agency shall send a soft copy of the document via email to the Department of Legal Affairs ([email protected]) as a basis for document consolidation.
3. No later than 05 working days from the date of signing and promulgation of the amended and supplemented circular, the Legal Department is responsible for completing the consolidation of documents and submitting the signature for authentication of the consolidated document according to regulations.
4. No later than 05 working days from the date of receipt of the amendment and supplement document from the President, Government, Prime Minister, document amending and supplementing joint documents between the Government and central agencies of socio-political organizations drafted by the Ministry of Transport; the Legal Department is responsible for completing the document consolidation and submitting the signature for authentication of the consolidated document according to regulations.

What are regulations on posting consolidated legal documents of the Ministry of Transport on the Official Gazette and the website in Vietnam?
Pursuant to Article 40 of Circular 26/2022/TT-BGTVT (effective from January 1, 2023) stipulating regulations on posting consolidated legal documents of the Ministry of Transport on the Official Gazette and the website in Vietnam as follows:
1. Posting of consolidated documents on the official websites of state agencies is carried out as follows:
a) The Legal Department is responsible for posting the consolidated document on the Ministry's website immediately after the consolidated document is signed and authenticated.
b) The Ministry's Office is responsible for sending the consolidated document to the Government Office within 2 working days from the date of authentication to be posted on the Government's website in the case of the amended or supplemented document issued by the Government or the Prime Minister.
2. The Ministry's Office is responsible for sending the consolidated document to the Gazette to be published after 2 working days from the date of authentication of the consolidated document by the Minister.
What are the responsibilities for legal documentation of the Ministry of Transport in Vietnam?
Pursuant to Article 41 of Circular 26/2022/TT-BGTVT (effective from January 1, 2023) stipulating responsibilities for legal documentation of the Ministry of Transport in Vietnam as follows:
1. The drafting agency is responsible for:
a) Organizing the implementation of codification for legal provisions in legal documents that it is responsible for drafting; legal provisions in legal documents submitted by agencies, organizations, and National Assembly deputies to adjust issues within the field assigned by the Minister to manage the state;
b) Timely updating new legal provisions that have been issued and removing legal provisions that have expired out of the Code of Legal Documents for the topics under the field assigned by the Minister to manage the state;
c) Ensuring the deadline, accuracy, and completeness of the content; following the procedures and procedures and complying with the codification techniques as prescribed in the Law on Codification of the System of Legal Documents 2012, Government Decree No. 63/2013/ND-CP dated June 27, 2013 detailing the implementation of the Law on Codification of the System of Legal Documents and Circular No. 13/2014/TT-BTP dated April 29, 2014 of the Minister of Justice guiding the implementation of codification of the system of legal documents.
2. The Legal Department is the focal point responsible for organizing the implementation of codification under the authority of the Ministry; guiding, monitoring, urging, and checking the results of codification implementation at the Ministry; coordinating with the Ministry of Justice (Legal Document Examination Bureau) in the work of codification of the system of legal documents; in case the highest legal document in the topic changes or builds a new topic, the Legal Department will coordinate with the units to organize the implementation of codification according to the regulations of the law on codification.
