What are regulations on assigning tasks to organize exams and consider promotions for civil servants of the Ministry of Industry and Trade in Vietnam?

Pursuant to Article 20 of the Regulations on recruitment, rank transfer, rank promotion of civil servants and cadre work of the Ministry of Industry and Trade issued together with Decision 222/QD-BCT in 2022 regulating the assignment of organizing examinations and promotion consideration for civil servants of the Ministry of Industry and Trade are as follows:

1. Examination for promotion of civil servant rank from major specialist or equivalent to senior specialist or equivalent

a) From main specialist rank to senior specialist rank:

The Department of Personnel Organization reviews, appraises, and submits to the Minister for approval the list of civil servants who meet the standards and conditions to participate in the rank promotion exam and proposes rank promotion quotas to the Ministry of Home Affairs.

b) From the rank of main market controller to the rank of senior market controller:

The Department of Personnel Organization coordinates with the General Department of Market Management to review, appraise, and submit to the Minister for approval the list of civil servants who meet the standards and conditions to take the rank promotion exam and propose rank promotion quotas to the Ministry of Home Affairs. 

The Ministry of Industry and Trade presides and coordinates with the Ministry of Home Affairs to organize the exam to upgrade to senior market controller.

2. Rank promotion exam from specialist rank or equivalent to major specialist rank or equivalent

The Department of Personnel and Organization reviews, appraises, and submits to the Minister for approval the list of qualified civil servants, conditions for taking the rank promotion exam, and proposed rank promotion quotas.

The Ministry of Industry and Trade presides over the organization of civil servant rank promotion exams after receiving comments on the content of the Project and rank promotion targets of the Ministry of Home Affairs.

3. Rank promotion exam from employee rank or equivalent to officer rank or equivalent; from officer rank or equivalent to specialist rank or equivalent

The Ministry of Industry and Trade presides over the organization of the civil servant rank promotion exam after receiving comments on the rank promotion quota of the Ministry of Home Affairs.

4. Exam for promotion from intermediate market controller to market controller

The General Department of Market Management presides over the organization of civil servant rank promotion exams after receiving opinions on rank promotion targets of the Ministry of Industry and Trade and the Ministry of Home Affairs.

5. Assignment of organization of civil servant rank promotion consideration is carried out similarly to assignment of organization of civil servant rank promotion examination.

What are duties and powers of the agency competent to organize the civil servant rank promotion exam of the Ministry of Industry and Trade in Vietnam?

Pursuant to Article 21 of the Regulations on recruitment, rank transfer, rank promotion of civil servants and cadre work of the Ministry of Industry and Trade issued together with Decision 222/QD-BCT in 2022 regulating agencies competent to organize exams civil servants are as follows:

1. The Department of Personnel and Organization advises and submits to the Minister

a. Develop a project to organize civil servant rank promotion exams organized by the Ministry of Industry and Trade;

b. Determine civil servant rank promotion targets appropriate to the job position and civil servant rank structure of each administrative agency under the Ministry;

c. Establish the Civil Servant Rank Promotion Exam Council;

d. Decide on a list of civil servants who meet the standards and conditions for taking the rank promotion exam;

e. Decide to organize civil servant rank promotion exam;

g. Recognize civil servant promotion exam results;

h. Inspect and supervise the organization of rank promotion examinations by the Civil Servant Rank Promotion Examination Council.

2. General Department of Market Management:

a. Develop a project to organize the civil servant rank promotion exam organized by the General Department;

b. Determine the civil servant rank promotion quota of the rank promotion exam organized by the General Department, in accordance with the employment position and civil servant rank structure of each administrative agency under the General Department (Department, Department, Office);

c. Establish the Civil Servant Rank Promotion Exam Council;

d. Decide on a list of civil servants who meet the standards and conditions for taking the rank promotion exam;

e. Decide to organize civil servant rank promotion exam;

g. Recognize civil servant promotion exam results;

h. Inspect and supervise the organization of rank promotion examinations by the Civil Servant Rank Promotion Examination Council.

3. Administrative agencies under the Ministry

a. Based on job positions, civil servant rank structure approved by competent authorities, the number of existing civil servants and standards and conditions for civil servant ranks according to regulations, administrative agencies under the Ministry review and establish list of civil servants meeting the standards and conditions to be nominated to take the rank promotion examination shall be sent to the Department of Personnel Organization or the General Department's advisory agency on personnel work.

b. Heads of administrative agencies under the Ministry are responsible before the Minister (or General Director) and before the law for checking and confirming background statements, moral qualities, conditions and standards for public employees. The position nominated for the exam falls under its management authority.
