d) Office of registration of copyright and related rights.

Center for assessment, information and transfer of copyright and related rights.

The Copyright Office is an administrative organization under the Ministry of Culture, Sports and Tourism, performing the function of advising and assisting the Minister in state management and organizing law enforcement on copyright protection, human rights and intellectual property rights and cultural industries nationwide; manage public services in the field of copyright and related rights protection in accordance with law.

The Copyright Office has its own seal and an account at the State Treasury.

Thus, the Copyright Office of Vietnam has the following functions:

- Advise and assist the Minister in state management and law enforcement on the protection of copyright, related rights and the cultural industry nationwide;

- Manage public services in the field of copyright and related rights protection in accordance with the law.

How many duties and powers does the Copyright Office of Vietnam have?

In Article 2 of Decision 912/QD-BVHTTDL 2023, there are 23 tasks and powers of the Copyright Office as follows:

1. Submitting to the Minister draft legal documents, strategies, mechanisms, policies, decentralization of state management, plans, programs, projects and schemes on copyright and related rights protection and develop cultural industries; draft plans, participate in negotiations, propose to sign, join, reserve, amend, supplement, extend, terminate the validity of international treaties, international commitments, international cooperation programs copyright, related rights, development of cultural industries and implementation organization after approval by the competent authority.

2. Guiding and implementing the provision, cooperation, ordering, use and guarantee of copyright to works and related rights to performances, phonograms, video recordings and programs broadcasting.

3. To organize the implementation of measures to develop cultural industries under the Ministry's state management; protect the legitimate rights and interests of organizations, individuals, the State and society in terms of copyright and related rights.

4. Managing and exploiting copyright in literary, artistic and scientific works, related rights to performances, phonograms, video recordings and broadcasts of which the State is the representative the owner or the State management representative; receive the transfer of copyright and related rights of organizations and individuals to the State according to the provisions of law.

5. Advise and assist the Minister in directing, guiding and organizing training and professional examination on copyright and related rights protection and cultural industry development for branches and localities units and social organizations as prescribed by law.

6. Managing activities of organizations representing collective copyrights and related rights and providing consultancy and services on copyright and related rights in accordance with law.

7. Manage and organize the assessment of copyright and related rights; issue, re-issue and revoke assessor cards and assessment organization certificates in accordance with law.

8. Issuance, re-issuance, renewal, invalidation of copyright registration certificates and related rights registration certificates. Establish and manage the national register of copyright and related rights; copyright certification.

9. To coordinate in organizing educational activities, propagating and disseminating legal knowledge, mechanisms and policies on copyright and related rights and developing cultural industries.

10. Organize information, communication, statistics and publishing activities on copyright, related rights and cultural industry.

11. To assume the prime responsibility for, and coordinate with relevant competent state agencies in, examining and settling complaints and denunciations about copyright and related rights in accordance with law. Cooperate with competent state agencies in inspecting and handling violations of the law on copyright and related rights in accordance with law.

12. Proposing to reward organizations and individuals with achievements in the protection of copyright and related rights and the development of cultural industries in accordance with the law.

13. Implement international cooperation and international integration on copyright, related rights and cultural industry under the Minister's decision.

14. Guiding and organizing the implementation of approval of the translation of works from foreign languages ​​into Vietnamese and the reproduction of works for teaching and research purposes not for commercial purposes in accordance with the provisions of the Annex to the Berne Convention on protection literary and artistic works.

15. Guide and organize the exploitation and use of published works, phonograms and video recordings of Vietnamese organizations and individuals but the copyright owners cannot be found or cannot be identified, related rights holders.

16. Advise and assist the Minister in approving and adjusting the royalty rate and payment method developed by the collective representative organizations of copyright and related rights.

17. Advise and assist the Minister to coordinate with the Ministry of Science and Technology in formulating general guidelines, policies and laws on protection of intellectual property rights, aggregating general information on intellectual property, implementing implementing joint international cooperation programs and projects on intellectual property and other related joint work.

18. Advise and assist the Minister to assume the prime responsibility for, and coordinate with concerned ministries and branches in, formulating general guidelines and policies on the development of cultural industries, and compile general information on the cultural industry and implement joint international cooperation programs and projects on the development of cultural industries.

19. Advise and assist the Minister in guiding the implementation of the Strategy for the development of cultural industries.

20. Implement administrative reform and digital transformation contents according to the programs and plans of the Ministry.
