Pursuant to Article 6 of the Regulation on operation of the Information System for handling administrative procedures, the Ministry of National Defense issued together with Decision 3689/QD-BQP in 2022 stipulating prohibited acts in the management and use of the Information System for handling administrative procedures of the Ministry of Defense of Vietnam as follows:

1. Prohibited acts when participating in the Information System for handling administrative procedures of the Ministry of National Defense shall comply with the provisions of Article 12 of the Law on Information Technology 2006 and Article 9 of the Law on Electronic Transactions 2005.

2. Other violations in accordance with relevant laws.

What are regulations on file codes and forms in the process of handling administrative procedures of the Ministry of National Defense of Vietnam?

Pursuant to Article 7 of the Regulation on operation of the Information System for handling administrative procedures, the Ministry of National Defense issued together with Decision 3689/QD-BQP in 2022 stipulating file codes and forms in the process of handling administrative procedures of the Ministry of National Defense of Vietnam as follows:

1. Dossier code, branch code, administrative procedure domain code shall comply with the provisions of Articles 19 and 20 of Circular No. 01/2018/TT-VPCP dated November 23, 2018 of the Minister, Chairman The Government Office guides the implementation of a number of provisions of Decree No. 61/2018/ND-CP.

2. Forms in the process of handling administrative procedures on the Information System for handling administrative procedures of the Ministry of National Defense are made according to the Appendix attached to this Regulation.

What are regulations on receiving and processing administrative procedures on the Information System for handling administrative procedures of the Ministry of National Defense of Vietnam?

Pursuant to Article 8 of the Regulation on operation of the Information System for handling administrative procedures, the Ministry of National Defense issued together with Decision 3689/QD-BQP in 2022 stipulating file codes and forms in the process of handling administrative procedures of the Ministry of National Defense of Vietnamregulations on receiving and processing administrative procedures on the Information System for handling administrative procedures of the Ministry of National Defense of Vietnam as follows:

1. Receipt of administrative procedures

a) For online application, the Information System for handling administrative procedures of the Ministry of National Defense receives the request and automatically checks it technically.

In case the dossier is complete with all components and technical guarantee, the automatic response will confirm that the organization or individual has successfully submitted and notify the time of official receipt of the dossier;

In case the dossier is incomplete or inconsistent with regulations, the agency handling administrative procedures must notify the organization or individual through the organization's or individual's account or other organizational information channels. registered organizations and individuals; provide full and specific instructions once for organizations and individuals to fully supplement dossiers upon request;

The notice time shall not exceed 08 working hours after the application is received by the Information System for handling administrative procedures of the Ministry of National Defense;

b) For dossiers submitted directly at the One-Stop-Shop Department of the Ministry of National Defense or through the public-utility postal service as prescribed by the Prime Minister, by hiring services from businesses or individuals or by authorization in accordance with regulations of law. According to the provisions of law, officials and employees who receive dossiers shall comply with the provisions of Clause 1, Article 17 of Decree No. 61/2018/ND-CP and digitize the dossiers according to the provisions of Clause 1, Article 21a. supplemented in Clause 11 Article 1 of Decree No. 107/2021/ND-CP.

2. Transfer of administrative documents

Immediately after receiving the administrative procedure dossiers as prescribed in Clause 1 of this Article, officials and employees at the One-Stop-Shop Division of the Ministry of National Defense shall transfer the dossiers to agencies or units competent to handle administrative procedures. administrative procedures prescribed in Article 18 of Decree No. 61/2018/ND-CP as amended and supplemented in Clause 9 Article 1 of Decree No. 107/2021/ND-CP.

3. Handling administrative documents

The handling of administrative procedure dossiers on the Information System for settlement of administrative procedures of the Ministry of National Defense shall comply with the provisions of Article 19 of Decree No. 61/2018/ND-CP and Clause 2, Article 21a (amended by Clause 11 Article 1 of Decree No. 107/2021/ND-CP).
