What are procedures for transferring individuals with meritorious services under the care of a facility managed by the province to home care in Vietnam?
Based on Article 1, Article 114 of Decree 131/2021/ND-CP (effective from 15/02/2022), the procedures for transferring individuals with meritorious services under the care of a facility managed by the province to home care are as follows:
- The individual shall submit a request in the form of Form 23 in Appendix I of this Decree to the Director of the care facility responsible for the care and supervision of individuals with meritorious services.
- The Director of the care facility shall, within 05 working days, send a written document to the Department of Labor, Invalids and Social Affairs.
- The Department of Labor, War Invalids and Social Affairs shall, within 05 working days from the date of receiving all necessary documents, issue a decision to bring the individual with meritorious services back to their family in accordance with Form 71 in Appendix I of this Decree for those under the management of the Department. In case the family of the individual with meritorious services is located in a different locality, the Department of Labor, War Invalids and Social Affairs shall arrange for the transfer of the individual's documents in accordance with regulations, instruct the care facility to transfer the decision, and organize the process of bringing the individual with meritorious services back to their family.

Under Article 2 of this Decree, the procedures for transferring individuals with meritorious services under the care of a facility supervised by the Ministry of Labor, War Invalids and Social Affairs to home care in Vietnam are as follows:
- The individual shall submit a request in the form of Form 23 in Appendix I of this Decree to the Director of the care facility responsible for the care and supervision of individuals with meritorious services.
- The Director of the care facility shall, within 05 working days, send a written document to the Ministry of Labor, War Invalids and Social Affairs.
- The Ministry of Labor, War Invalids and Social Affairs shall, within 12 working days from the date of receiving all necessary documents, issue a decision to bring the individual with meritorious services back to their family in accordance with Form 71 in Appendix I of this Decree.
- The care facility shall, within 05 working days from the date of receiving the decision from the Ministry, be responsible for transferring the decision, organizing the process of bringing the individual with meritorious services back to their family, and arranging for the transfer of the individual's documents.
