What are procedures for electing the President of Vietnam at the National Assembly session?

Pursuatn to Article 33 of the National Assembly's Session Regulations issued together with the Resolution 71/2022/QH15 (effective from March 15, 2023) stipulating procedures for electing the President of Vietnam at the National Assembly session as follows:

1. The National Assembly Standing Committee shall submit a list of nominees for the National Assembly to elect the President.

2. In addition to the list proposed by the Standing Committee of the National Assembly, National Assembly deputies have the right to nominate or nominate themselves for the position of State President; the person nominated to be a candidate has the right to withdraw from the list of candidates.

3. National Assembly deputies discuss at the National Assembly Delegation; The President of the National Assembly may meet with the Heads of the National Assembly Delegation to discuss related issues.

4. The National Assembly Standing Committee shall report to the National Assembly on the explanation and reception of opinions of the National Assembly deputies discussed at the National Assembly Delegation; submit to the National Assembly for decision a list of candidates introduced by National Assembly deputies or self-nominated (if any).

5. The National Assembly discusses and votes on the list to elect the President.

6. The National Assembly establishes a vote counting committee.

7. The National Assembly elects the President by secret ballot.

8. The Vote Counting Board shall report on the vote counting and voting results.

9. The National Assembly Standing Committee shall submit to the National Assembly a draft resolution to elect the President.

10. The National Assembly discussed.

11. The Standing Committee of the National Assembly shall report to the National Assembly on the explanation and reception of opinions of the National Assembly deputies and the revision of the draft resolution.

12. The National Assembly votes to approve the draft resolution.

13. The President takes the oath.

Pursuatn to Article 34 of the National Assembly's Session Regulations issued together with the Resolution 71/2022/QH15 (effective from March 15, 2023) stipulating the decision on the organizational structure of the Government of Vietnam at the National Assembly session as follows:

1. A dossier to be submitted to the National Assembly for decision on the organizational structure of the Government includes:

a) A report on the organizational structure of the Government;

b) The draft resolution;

c) Verification report of the Law Committee of the National Assembly;

d) Other documents (if any).

2. At the first session of each National Assembly, the National Assembly shall decide on the organizational structure of the Government in the following order:

a) The representative of the previous Government presents the report;

b) The representative of the National Assembly's Law Committee presents the verification report;

c) National Assembly deputies discuss at the National Assembly Delegation; The President of the National Assembly may meet with the Heads of the National Assembly Delegation and invite the Prime Minister of the previous term to attend to discuss related issues;

d) The previous Government shall report to the National Assembly on its explanation and absorption of opinions discussed by National Assembly deputies at the National Assembly Delegation;

d) The National Assembly discusses;

e) The previous Government shall report to the National Assembly on the explanation and absorption of opinions of the National Assembly deputies and the revision of the draft resolution;

g) The National Assembly votes to approve the draft resolution.

Pursuatn to Article 35 of the National Assembly's Session Regulations issued together with the Resolution 71/2022/QH15 (effective from March 15, 2023) stipulating procedures for electing the Vice President, Prime Minister, Chief Justice of the Supreme People's Court, and Chief Procurator of the Supreme People's Procuracy of Vietnam at the National Assembly session as follows:

1. The State President shall submit a list of nominees for the National Assembly to elect the Vice President, the Prime Minister, the Chief Justice of the Supreme People's Court, and the Chief Procurator of the Supreme People's Procuracy.

2. In addition to the list proposed by the President, National Assembly deputies have the right to nominate or nominate themselves for the position of Vice President, Prime Minister, Chief Justice of the Supreme People's Court, and Director of the Institute. Supreme People's Procuracy; the person nominated to be a candidate has the right to withdraw from the list of candidates.

3. National Assembly deputies discuss at the National Assembly Delegation; The President of the National Assembly may meet with the Heads of the National Assembly Delegation and invite the State President to attend to discuss related issues.

4. The President shall report to the National Assembly on the explanation and reception of opinions of the National Assembly deputies discussed at the National Assembly Delegation.

6. The National Assembly discusses and votes on a list to elect the Vice President, the Prime Minister, the Chief Justice of the Supreme People's Court, and the Chief Procurator of the Supreme People's Procuracy.

7. The National Assembly establishes a vote counting committee.

8. The National Assembly elects the Vice President, the Prime Minister, the Chief Justice of the Supreme People's Court, and the Chief Procurator of the Supreme People's Procuracy by secret ballot.

9. The Vote Counting Board shall report on the vote counting and voting results.

10. The National Assembly Standing Committee shall submit to the National Assembly a draft resolution to elect the Vice President, the Prime Minister, the Chief Justice of the Supreme People's Court, and the Chief Procurator of the Supreme People's Procuracy.
