What is scope of regulation and subjects of application for the establishment and dissolution of public service units in Culture, Family, Sports and Tourism in Vietnam?

Pursuant to Article 1, Article 2 of Circular 14/2021/TT-BVHTTDL stipulates:

Article 1. Scope

This Circular regulates criteria for classification and conditions for establishment, merger, consolidation and dissolution of public service units in the fields of culture, family, sports and tourism.

Article 2. Subjects of application

1. This Circular applies to public service units in the fields of culture, family, sports and tourism, including:

a) Public service units under the management of ministries and ministerial-level agencies (hereinafter referred to as ministries), including:

- Public service units under the ministry (including: Public service units under the organizational structure of the ministry, public service units under the ministry and public service units abroad);

- Public service units under the general department and organizations equivalent to the general department under the ministry;

- Public service unit under the department of the ministry;

- Public service unit under the Ministry's Office.

b) Public service units under Government agencies (including public service units abroad).

c) Public service units under organizations established by the Government or Prime Minister and not public service units.

d) Public service units under the management of the People's Committees of provinces and centrally run cities (hereinafter referred to as provincial level), including:

- Public service unit under the Provincial People's Committee;

- Public service unit under the Department of Culture, Sports and Tourism; Department of Culture and Sports; Department of Tourism under the Provincial People's Committee;

- Public service units under other administrative organizations under the Provincial People's Committee.

d) Public service units under the People's Committees of districts, towns, provincial cities, and centrally run cities.

2. Public service units under public service units specified in Clause 1 of this Article and public service units belonging to the fields of culture, family, sports and tourism belonging to political organizations, Socio-political organizations shall base themselves on the provisions of this Circular, the Party's regulations and relevant laws to apply accordingly.

3. This Circular does not apply to:

a) Public service units under the armed forces;

b) Public service units under the management of the special administrative-economic unit government.

Article 3. Principles for establishment, merger, consolidation and dissolution of public service units in the fields of culture, family, sports and tourism

1. Ensure the principles specified in Article 4 of Decree No. 120/2020/ND-CP dated October 7, 2020 of the Government regulating the establishment, reorganization and dissolution of public service units (Decree No. 120/2020/ND-CP for short).

2. Ensure the maintenance of functions and tasks to serve state management and provide public services in the fields of culture, family, sports and tourism.
