What are duties and powers of the Ministry of Information and Communications of Vietnam on network information security?

Pursuant to Clause 16, Article 2 of the Decree 48/2022/ND-CP stipulating network information security as follows:

a) Information security management; ensure information security for information systems, information technology application and development activities; spam prevention and combat; ensure the safety of personal information online; protect children in cyberspace; organize the performance of the function of management and coordination of activities to respond to cyberinformation security incidents nationwide; assume the prime responsibility for coordinating emergency response to ensure national cyberinformation security in accordance with law;

b) Manage production and business activities of information security products and services; managing activities of inspection, assessment and certification of information security; grant, extend, amend, supplement, temporarily suspend, suspend or revoke licenses for trading in cyberinformation security products and services (except for civil cryptographic products and services; products and services; network security services) in accordance with the law;

c) Manage the quality of network information security products and services (except for civil cryptographic products and services, and network security products and services) in accordance with law;

d) Build and organize the operation of information security assurance systems, national-scale centralized technical infrastructure systems to handle and minimize cyber attacks, and support information security monitoring. for the information system to provide online public services, to develop e-Government; appraisal of network information security in information system design dossiers, information system security levels; manage information security supervision in accordance with law;

dd) Cooperate with the Ministry of Public Security in ensuring security and safety of key national security-related works in the field of information technology.

What are duties and powers of the Ministry of Information and Communications of Vietnam regarding electronic transactions?

Pursuant to Clause 17, Article 2 of the Decree 48/2022/ND-CP stipulating electronic transactions as follows:

a) Guide, direct and organize the implementation of strategies, plans and policies on development and application of e-transactions according to their competence;

b) Submitting to competent authorities for promulgation, recognition or promulgation, recognition according to competence standards in electronic transactions;

c) Manage service providers related to e-transactions under the ministry's management in accordance with law;

d) Manage the development of technology infrastructure for e-transactions in accordance with law;

dd) Promulgate regulations on digital signatures and digital signature authentication services according to their competence; assume the prime responsibility for, and coordinate with the Ministry of Public Security and the Government Cipher Committee in managing organizations providing digital signature certification services; organizations providing national digital signature authentication services as prescribed by law.

What are duties and powers of the Ministry of Information and Communications of Vietnam on public non-business services?

Pursuant to Clause 29, Article 2 of the Decree 48/2022/ND-CP stipulating public non-business services as follows:

a) State management of public non-business services in sectors and fields under the Ministry's state management in accordance with law;

b) Promulgate or amend, supplement economic - technical norms, cost norms (if any) as the basis for promulgating unit prices and prices of public administrative services using the state budget as the basis to assign tasks, place orders or bid for the provision of public non-business services in accordance with law;

c) Promulgate criteria and standards for the quality of public administrative services funded with the state budget; a mechanism for monitoring, evaluation, and accreditation of quality and regulations on inspection and acceptance of public non-business services funded by the state budget; operational efficiency of public non-business units as prescribed by law;

d) Perform the task of state management of public administrative service prices in accordance with the law on prices;

dd) Guide organizations to perform public non-business services in accordance with law.

What are duties and powers of the Ministry of Information and Communications of Vietnam regarding enterprises?

Pursuant to Clause 30, Article 2 of the Decree 48/2022/ND-CP stipulating enterprises as follows:

a) Assume the prime responsibility for, and coordinate with concerned ministries and branches in submitting to the Government for promulgation mechanisms and policies to encourage and support enterprise development in the field of information and communication; coordinate with relevant agencies and organizations in directing, guiding and inspecting the implementation;

b) Approve or submit to competent authorities for approval a master plan on restructuring, a scheme on reorganization of renovation and development of state-owned enterprises operating in the field of information and communication, approved by the Ministry of Information and Communications to manage and direct the implementation according to assignment and decentralization;

c) Guide and inspect the implementation of regulations on conditional business lines and services and handle violations within their competence;

d) Exercise the rights, responsibilities and obligations of the state owner towards state enterprises and the state capital invested in other enterprises in accordance with law.
