What are duties and powers of the Department of Labor, War Invalids and Social Affairs of Hanoi in the field of labor and salary?

Pursuant to Clause 7 Article 2 of the Decision 40/2022/QĐ-UBND stipulating duties and powers of the Department of Labor, War Invalids and Social Affairs of Hanoi in the field of labor and salary as follows:

a) Guide and organize the implementation of the provisions of the law on labor contracts, labor discipline, material responsibility, dialogue at work, collective bargaining, collective bargaining agreement, settlement of labor disputes and strikes, regimes for employees in the arrangement, reorganization, sale, lease, transformation of enterprises, transfer of ownership, right to use assets of enterprises or cooperatives; dissolution, bankruptcy of enterprises; in reorganizing, renovating and improving the operational efficiency of state-owned enterprises.

b) Guide the implementation of the provisions of the law on the salary regime in the production and business sector.

c) Guide the implementation of the provisions of the law on female employees and ensuring gender equality, elderly employees, employees with disabilities, underage workers, and domestic workers and some other workers.

d) Guide and organize the implementation of the provisions of the law on labor subleasing in the locality.

dd) Guide and organize the implementation of the provisions of the labor law on the registration and state management of the organization and operation of the employee's organizations at the enterprise in accordance with the law and as assigned or authorized by the City People's Committee.

What are duties and powers of the Department of Labor, War Invalids and Social Affairs of Hanoi in the field of social insurance?

Pursuant to Clause 8 Article 2 of the Decision 40/2022/QĐ-UBND stipulating duties and powers of the Department of Labor, War Invalids and Social Affairs of Hanoi in the field of social insurance as follows:

a) Guide and organize the implementation of the provisions of the law on social insurance within the locality according to the provisions of the law and as assigned or authorized by the City People's Committee.

b) Advise the City People's Committee to make recommendations in which to propose handling plans (if any) with relevant ministries and branches to deal with social insurance issues within their competence.

c) Receive dossiers and determine the number of employees participating in social insurance who are temporarily laid off for agencies, units, organizations and enterprises under the management of the City People's Committee requesting the retirement and survivorship fund.

d) Assume the prime responsibility for, and coordinate with the Social Insurance agency and relevant agencies in, organizing the implementation of social insurance propaganda in the locality in accordance with the characteristics of each target group in the locality on the basis of the social insurance propaganda plan in each period approved by the Ministry of Labor, War Invalids and Social Affairs.

What are duties and powers of the Department of Labor, War Invalids and Social Affairs of Hanoi in the field of occupational safety and health?

Pursuant to Clause 9 Article 2 of the Decision 40/2022/QĐ-UBND stipulating duties and powers of the Department of Labor, War Invalids and Social Affairs of Hanoi in the field of occupational safety and health as follows:

a) Guide and organize the implementation of the provisions of the law on occupational safety and sanitation; on working time and rest time within the locality; Month of action on occupational safety and health;

b) Guidie and implement the management and quality inspection of products and particular goods in terms of occupational safety; receive dossiers and handle procedures for announcing the conformity of specific products and goods on occupational safety in the locality.

c) Guide technical inspection of occupational safety; receive documents and confirm the declaration and use of machines, equipment and supplies with strict requirements on occupational safety.

d) Assume the prime responsibility for, and coordinate with, in organizing the investigation of fatal occupational accidents and occupational accidents that seriously injure 2 or more employees; re-investigate occupational accidents and coordinate with the health sector in investi the implementation of measures to prevent and share risks of occupational accidents and diseases in the locality; organize the collection and storage of information on the occupational accident situation; announce and assess the situation of occupational accidents and technical incidents causing serious occupational unsafety and sanitation occurring in the locality.

e) Receive documents announcing the organization of overtime from over 200 hours to 300 hours in a year from enterprises, agencies, organizations and individuals employing employees in the area under their management.
