3. Draft decision on decentralization and authorization of state management tasks in health to the Department of Health, the People's Committee of Thu Duc city, the People's Committees of districts and agencies and organizations according to the provisions of law.

4. Draft decision specifying the functions, tasks, powers and organizational structure of the Department of Health; functions, tasks, powers and organizational structure of the branch and public non-business units under the Department of Health.

5. Draft decision to socialize the provision of public non-business services in the health sector under the authority of the City People's Committee and according to the decentralization of superior state agencies.

Pursuant to Article 5 of the Regulation on functions, tasks, powers and organizational structure of the Department of Health of Ho Chi Minh City issued together with the Decision 29/2022/QD-UBND of Ho Chi Minh City stipulating duties and powers of the Ho Chi Minh City Department of Health regarding law enforcement as follows:

1. Advise and organize the implementation of legal documents, master plans, plans, programs, schemes, projects and other documents on health after being approved; information, propaganda, guidance, dissemination and education of the law and monitoring of law enforcement in the fields according to the state management tasks of the Department of Health.

2. Receive dossiers and certify advertising contents for special products, goods and services within the scope of state management of the Department of Health in accordance with law and as assigned or authorized by the City People's Committee, the Ministry of Health.

Pursuant to Article 6 of the Regulation on functions, tasks, powers and organizational structure of the Department of Health of Ho Chi Minh City issued together with the Decision 29/2022/QD-UBND of Ho Chi Minh City stipulating duties and powers of the Ho Chi Minh City Department of Health regarding preventive medicine as follows:

1. Direct, guide and evaluate the implementation of professional regulations and national technical regulations on prevention and control of infectious diseases and HIV/AIDS, non-communicable diseases, occupational diseases, accidents and injuries; identify drug addiction, prevention and treatment of addiction to opiates and other narcotic substances; environmental health, climate change, school health, hygiene and occupational health; community nutrition; border medical quarantine; waste management in medical facilities; manage insecticidal and germicidal chemicals and preparations used in household and medical fields in Ho Chi Minh City.

2. Direct and organize the surveillance of infectious diseases and HIV/AIDS, non-communicable diseases, diseases of unknown cause, risk factors affecting health, and other public health issues; detect and treat infectious diseases causing epidemics; notify the epidemic situation according to the provisions of law; advise the City People's Committee on the announcement of the epidemic and the announcement of the end of the epidemic in accordance with the law.

3. Direct and organize vaccination activities and use of medical biological products for subjects according to the provisions of law; organize the receipt of dossiers, and post information about establishments that have announced eligibility for vaccination on the website of the Department of Health in accordance with law.

4. Receive the self-declaration of meeting biosafety standards from testing establishments; post a list of establishments that have self-declared meeting the level I and level II biosafety standards on the website of the Department of Health in accordance with the law.

5. Issue, adjust and withdraw the certificate of eligibility for testing for affirmative HIV cases and suspending activities of testing for affirmative HIV cases in accordance with law.

6. Announce and re-announce qualified establishments, suspend or cancel dossiers of announcement of establishments eligible for treatment of addiction to opiates with substitute drugs in accordance with law.

7. The focal point on the prevention of the harmful effects of tobacco and the prevention of the harmful effects of alcohol and beer in Ho Chi Minh City.

8. Be Standing Committee of Epidemic Prevention and Control; Standing Standing Committee of the City HIV/AIDS Prevention and Control Committee.

9. Manage, guide and organize the implementation of working environment monitoring activities at labor establishments; assessment, control and management of factors harmful to health in the workplace; build a database on working environment monitoring activities, announce working environment monitoring organizations that are eligible for operation and environmental monitoring organizations that have been suspended from operation in accordance with law; advise the City People's Committee to promulgate local technical regulations on the quality of clean water used for domestic purposes and to inspect and supervise the implementation according to regulations.

10. Guide according to its competence the management of occupational hygiene, health examination of employees, examination and detection of occupational diseases, and management of workers' health at the workplace; manage the training, granting professional certificates of occupational health, training in first aid and emergency at the workplace in accordance with the law.

11. Direct, guide, supervise, examine and inspect the implementation of professional regulations and national technical regulations in the field of preventive medicine in Ho Chi Minh City.
