What are duties and powers of the Department of Culture and Sports of Ho Chi Minh City?

Pursuant to Article 2 of the Regulation on functions, tasks, powers and organizational structure of the Department of Culture and Sports of Ho Chi Minh City issued together with the Decision 33/2022/QD-UBND of Ho Chi Minh City stipulating duties and powers as follows:

1. Submit to the People's Committee of Ho Chi Minh City:

a) Draft decision of the People's Committee of Ho Chi Minh City related to the sectors and fields under the management of the Department and other documents as assigned by the People's Committee of Ho Chi Minh City;

b) Draft plan for development of the sector or field; programs and measures to organize and perform tasks related to sectors and fields in Ho Chi Minh City within the scope of management of the Department;

c) Draft decision on decentralization and delegation of state management tasks over sectors and fields to the Department, the People's Committee of the city under the city, the People's Committee of the district;

d) Draft decision specifying the functions, tasks, powers and organizational structure of the Department;

dd) Draft decision on socialization of public non-business service provision activities by sectors and fields under the jurisdiction of the People's Committee of Ho Chi Minh City and as decentralized by superior state agencies.

2. Submit to the Chairman of the People's Committee of Ho Chi Minh City:

a) Draft documents under the promulgation authority of the President of Ho Chi Minh City People's Committee as assigned.

b) Draft decision stipulating the functions, tasks, powers and organizational structure of the public non-business units under the Department.

3. Organize the implementation of legal documents, master plans and plans after they are approved; inform, propagate, guide, disseminate, educate and monitor law enforcement in the fields under the assigned state management scope.

4. Regarding cultural heritage:

a) Organize the implementation of regulations and solutions for mobilizing, managing and using resources to protect and promote the value of cultural heritage in Ho Chi Minh City after being approved;

b) Organize the research, collection, inventory and documentation of intangible cultural heritage in Ho Chi Minh City; granting permits to research and collect intangible cultural heritages in the area for overseas Vietnamese, foreign organizations and individuals;

c) Manage and guide the organization of activities to protect and promote the value of cultural heritage, traditional festivals and beliefs associated with historical relics and figures in Ho Chi Minh City;

d) Organize inventory, make a list, compile dossiers for ranking of historical - cultural relics and scenic spots in Ho Chi Minh City;

dd) Appraise and request for approval of planning tasks and planning on preservation, renovation and restoration of relics under the competence of the President of the People's Committee of Ho Chi Minh City; Appraise projects on preservation, renovation and restoration of relics, economic and technical reports on preservation, renovation and restoration of monuments for provincial-level relics and submit them to the Chairman of the People's Committee of Ho Chi Minh City for approval; participate in the design of construction drawings for preservation, restoration and restoration of provincial-level monuments; give opinions on dossiers of urgent repair, periodical preservation of relics or objects of relic inventory; appraise projects on renovation and construction of works located outside the provincial-level relic protection area in Ho Chi Minh City that are likely to affect the landscape and environment of the monument; grant, reissue, and revoke relic restoration practice certificates and practice certificates to relic restoration practicing organizations headquartered in Ho Chi Minh City;

h) Organize the collection and preservation of relics, antiquities and national treasures handed over and confiscated by organizations and individuals in Ho Chi Minh City in accordance with law; organize the registration and management of relics, antiquities and national treasures; issue practice certificates to shop owners trading relics, antiquities and national treasures; grant permits to make copies of relics, antiquities and national treasures belonging to national relics, provincial relics, provincial museums and private ownership in Ho Chi Minh City; grant, re-issue and revoke certificates of eligibility for antique assessment business, for assessment business establishments headquartered in Ho Chi Minh City; request the Minister of Culture, Sports and Tourism for permission to bring private relics and antiquities abroad for display, exhibition, research or preservation;

i) Confirming the conditions for the establishment of a provincial-level museum and the conditions for being granted an operating license for a non-public museum in Ho Chi Minh City; consider and decide on sending the written request and the dossier for ranking class II, III museums for provincial-level museums and non-public museums to the Chairman of the People's Committee of Ho Chi Minh City to organize the appraisal of museum ratings; sugges and propose for approval of provincial-level museum display projects and local-managed souvenir house display projects;

k) Inspect, supervise and coordinate with units under the Ministry of Culture, Sports and Tourism in inspecting training facilities and organizing the implementation of the program on knowledge training on preservation, renovation and restoration of historical - cultural relics and scenic spots in Ho Chi Minh City;

l) Act as a standing body advising the People's Committee of Ho Chi Minh City to submit to the People's Council of Ho Chi Minh City on: naming, renaming streets, streets, squares and public works in the locality.

5. About performing arts:

a) Advise and submit to the People's Committee of Ho Chi Minh City to perform state management tasks or advise the People's Committee of Ho Chi Minh City to decentralize and authorize the performance of state management tasks, decide on administrative procedures for performing arts activities under the management of Ho Chi Minh City according to the provisions of law and organize the implementation after they are approved;

b) Guide and organize the implementation of the planning related to performing arts units under the management of Ho Chi Minh City in accordance with the law;

c) Issue documents certifying that Vietnamese individuals participate in beauty contests and models abroad in accordance with law.

6. About cinema:

a) Organize the implementation of the plan to use the state budget to ensure funding for cinema screenings and mobile cinema screenings to serve political, social and foreign affairs tasks, to serve children and the ethnic people, mountainous areas, islands and armed forces;

b) Act as the standing duty of the Council for appraisal of literary scripts for the production of films ordered from the state budget, the Council for the appraisal of films at the provincial level in accordance with the law on cinematography;

c) Granting and revoking permits for the dissemination of reportage films, documentaries, scientific films, cartoons and films using special effects affecting moviegoers produced or imported by a cinema establishment in Ho Chi Minh City;

d) Issue and revoke permits for the dissemination of feature films produced or imported by cinema establishments in Ho Chi Minh City in accordance with the law on cinematography;

d) Check the dissemination of movies in theaters, mobile movies, movies broadcast on other means at places of public cultural, entertainment and entertainment activities;

7. About art, photography and exhibitions:

a) Organize the implementation of fine art, photography and exhibition activities under the management of Ho Chi Minh City;

b) Receive dossiers, appraise and submit them to the People's Committee of Ho Chi Minh City for granting permits for fine art exhibitions, for granting permits to build monuments and murals, and for granting permits to organize sculpture camps, grant and revoke permits to exhibit photographic works in Vietnam; grant and revoke permits to bring photographic works from Vietnam abroad for exhibition in accordance with law;

c) Grant licenses to copy fine art works of cultural celebrities, national heroes and leaders; granting, re-granting and withdrawing permits to organize exhibitions that are carried abroad by local organizations and individuals for non-commercial purposes and by foreign individuals organized locally for non-commercial purposes; approve the content of fine art works and photographic works imported for business purposes in accordance with law;

d) Receive the notice of organization of competition for the creation of fine art works under the management of Ho Chi Minh City; receive notices of exhibition organization or temporary suspension of exhibition activities organized by organizations or individuals in Ho Chi Minh City for non-commercial purposes as prescribed by law;

dd) Manage the activities of buying, selling, displaying and copying fine art works in Ho Chi Minh City.

8. Regarding copyright and related rights:

a) Organize the implementation of measures to protect the legitimate rights and interests of the State, organizations and individuals regarding copyright and related rights in accordance with law;

b) Organize the implementation, guide and inspect the implementation of regulations on supply, cooperation, ordering, use and guarantee of copyright to works, related rights to performances, phonograms, video recordings, broadcasts and the regime of royalties and remuneration for authors, copyright and related rights holders in Ho Chi Minh City.

9. Regarding cultural industry:

Organize the implementation of goals and tasks for the development of cultural industries in Ho Chi Minh City; organize the review, propose or propose to competent authorities to promulgate necessary mechanisms, policies and solutions for the development of cultural industries in Ho Chi Minh City.

10. About the library:

a) Assume the prime responsibility for, and coordinate with the Department of Information and Communications in, advising the People's Committee of Ho Chi Minh City to regulate the receipt of publications in the locality of the provincial library; coordinate with the Department of Information and Communications in transferring publications deposited in the locality to the provincial library in accordance with the law;

b) Receive and give a written reply to the notice of establishment, merger, consolidation, division, separation, dissolution or termination of library operations of specialized libraries at provincial or district level; university libraries, libraries of foreign organizations and individuals serving Vietnamese people based in Ho Chi Minh City as decentralized and authorized by the People's Committee of Ho Chi Minh City;

c) Guide libraries in Ho Chi Minh City to develop organizational and operational regulations according to regulations of the Ministry of Culture, Sports and Tourism;

d) Submit to competent authorities for promulgation policies to support and attract the building and development of a local library network, and to encourage organizations and individuals to maintain community libraries, a private library that serves the local community; library modernization; build a mechanism for coordination between libraries and agencies and organizations to develop libraries and reading culture in the locality.

11. About advertising:

a) Assume the prime responsibility for, and coordinate with relevant departments, agencies and sectors in appraising and submitting to the People's Committee of Ho Chi Minh City for granting, re-granting, amending, supplementing and revoking the representative office establishment license of foreign advertising enterprises located locally;

b) Receive and process dossiers of announcement of advertising products on billboards and banners; notify the organization of a delegation of people performing advertising in the locality;

c) Assist the People's Committee of Ho Chi Minh City in organizing the formulation, approval and implementation of the outdoor advertising planning, and periodically report on the management of advertising activities in Ho Chi Minh City;

d) Inspect and handle according to its competence violations of the law on advertising activities on advertising media as prescribed by law.

12. Regarding mass culture, national culture and propaganda:

a) Guide and organize the implementation of the planning related to grassroots cultural and sports institutions in Ho Chi Minh City after being approved by the People's Committee of Ho Chi Minh City;

b) Guide the formulation of regulations on organization and operation of grassroots cultural and sports institutions in Ho Chi Minh City according to regulations of the Ministry of Culture, Sports and Tourism;

c) Guide the implementation of a civilized lifestyle in marriage and mourning; build cultural families, cultural residential areas, agencies and units meeting cultural standards in Ho Chi Minh City;

d) Assume the prime responsibility for, and coordinate with other departments, agencies, sectors and mass organizations in directing and guide the movement "All people unite to build a cultural life"; responsible for being the standing body of the Steering Committee of the movement "All people unite to build a cultural life" in Ho Chi Minh City;

dd) Organize and inspect the implementation of policies on ethnic culture, preserve, promote and develop tangible and intangible cultural values ​​of ethnic communities in Ho Chi Minh City;

e) Guide and organize the implementation of the plan of propaganda activities serving political, economic, cultural, social and planning tasks related to the visual promotion system in Ho Chi Minh City. Chi Minh;

i) Guide and inspect the use of the national flag, the national emblem, the national anthem and the portrait of President Ho Chi Minh in accordance with the law;

k) Advise, guide and inspect the implementation of regulations on establishment date, traditional date, response date in Ho Chi Minh City;

l) Guide the organization of festivals, manage festival activities, implement a civilized lifestyle during festivals.

13. Advise the People's Committee of Ho Chi Minh City on the organization of large-scale cultural and sports festivals in Ho Chi Minh City. Permanent member of the Organizing Committee of Ho Chi Minh City's major holidays.

14. Guide, organize the implementation and inspect the formulation and implementation of local conventions and conventions according to the provisions of law.

15. About literature:

a) Organize the implementation of mechanisms and policies on literary activities in Ho Chi Minh City in accordance with law;

b) Guide, organize the implementation and inspect literary activities in Ho Chi Minh City according to the provisions of law.

16. Regarding family work:

a) Organize the implementation and inspect the implementation of the provisions of the law related to family work, ensure gender equality in the family and prevent and combat domestic violence;

b) Advise the People's Committee of Ho Chi Minh City in building and consolidating the contingent of human resources doing household chores;

c) Propaganda and education on morality, lifestyle and behavior in Vietnamese families;

17. Regarding physical training and sports:

a) Guide and organize the implementation of relevant master plans and plans on development of physical training and sports in Ho Chi Minh City after being approved;

b) Cooperate with socio-professional organizations in sports in propagating about the benefits and effects of physical training and sports; mobilize everyone to participate in the development of physical training and sports movements; disseminating knowledge and guiding exercise and sports in accordance with the people's interests, ages, gender, occupation and health status;

dd) Assist the People's Committee of Ho Chi Minh City in state management of sports and entertainment activities in Ho Chi Minh City;

e) Assume the prime responsibility for, and coordinate with relevant organizations and agencies in, facilitating and guiding the elderly, people with disabilities, children, adolescents and other mass objects to participate in physical education activities, sport;

g) Organize the exploitation, conservation, training, performance and competition of ethnic sports, folk games and traditional health training methods; coordinate with relevant agencies and organizations in disseminating ethnic sports abroad;

h) Guide and organize the inspection and assessment of mass physical training and sports movements in Ho Chi Minh City;

i) Coordinate with the Department of Education and Training, the Department of Labor - Invalids and Social Affairs, the Ho Chi Minh City High Command, the Ho Chi Minh City Public Security, the Ho Chi Minh City Border Guard and other agencies. Relevant agencies shall organize the implementation of physical education and sports activities in training institutions, vocational education institutions, armed forces and export processing zones and industrial parks in Ho Chi Minh City;

l) Formulate plans and guide the organization of physical training and sports congresses at all levels; coordinate with relevant departments, agencies and agencies to organize national, regional and international tournaments after being assigned and approved by competent authorities;

m) Organize the implementation of regimes and policies for coaches, referees and athletes of Ho Chi Minh City in physical training and sports competitions after being approved by competent authorities and according to regulations of the Law;

n) Organize the inspection of business conditions for sports activities of professional sports clubs, enterprises and households doing business in sports activities; issue certificates of eligibility for sports business to professional sports clubs and sports business enterprises in accordance with law.

18. Perform emulation and commendation work in the assigned management domains according to the provisions of the law on emulation and commendation.

19. Organize the implementation and take responsibility for the assessment, registration, licensing, diplomas and certificates under the management responsibility of the Department of Culture and Sports of Ho Chi Minh City in accordance with the law and as assigned or authorized by the People's Committee of Ho Chi Minh City.

20. Assist the People's Committee of Ho Chi Minh City in state management of enterprises, collective economic organizations, the private economy, associations, federations and non-governmental organizations in the field of culture, family, physical training and sports as prescribed by law.

21. Guide the implementation of the autonomy mechanism for public non-business units under their respective management sectors and domains according to the provisions of law; manage the operation of non-business units inside and outside the public sector within the scope of industries and fields.

22. Specify the functions, tasks and powers of the Department's Office, the Department's Inspector, and the specialized and professional divisions of the Department of Culture and Sports in accordance with the Department's functions, tasks and powers according to the general guidance of the Ministry of Culture, Sports and Tourism and the regulations of the People's Committee of Ho Chi Minh City.

23. Manage the organizational apparatus, civil servant payroll, civil servant rank structure, employment positions, public employee structure by professional title and number of people working in public non-business units; implement the salary regime and policies, regimes of treatment, training, retraining, reward and discipline for civil servants, public employees and employees under their management according to the provisions of law and as assigned or authorized by the People's Committee of Ho Chi Minh City.

29. Carry out information and reporting periodically and irregularly on the performance of assigned tasks according to regulations to the People's Committee of Ho Chi Minh City and the Ministry of Culture, Sports and Tourism.

30. Implement international cooperation in the fields of culture, family, physical training and sports in accordance with the law and as assigned or authorized by the People's Committee of Ho Chi Minh City.

31. Perform other tasks assigned by the People's Committee of Ho Chi Minh City, the President of the People's Committee of Ho Chi Minh City and according to the provisions of law.

2. Public non-business units directly under the Department

a) Public non-business units under the Department include 32 units:

b) Public non-business units must ensure the minimum number of employees is 15 people (except for public non-business units providing basic and essential public non-business services established under the provisions of specialized law).

c) Regarding the frame of number of deputies of the head of the public administrative unit: For public non-business units that cover their own recurrent and investment expenditures: The number of deputy heads of the units shall be made according to the provisions of this Decree. Pursuant to Article 5 of the Regulation on functions, tasks, powers and organizational structure of the Department of Culture and Sports of Ho Chi Minh City issued together with the Decision 33/2022/QD-UBND of Ho Chi Minh City stipulating establishment of the Advisory Council of the Department of Culture and Sports of Ho Chi Minh City as follows:

The Director of the Department of Culture and Sports may establish advisory councils for the Director in a number of specialized areas within the scope of functions and tasks of the sector to appraise cultural, family, and cultural activities, sports and other activities. These Councils are chaired by the Director of the Department or the Deputy Director of the Department. The conclusions of the Board must be fully reported for the Director to make a final decision. Members of the Advisory Councils work on a part-time basis.
