What are constructions of material and technical foundations for protection of state secrets in Ho Chi Minh City, Vietnam?
In Article 7 of the Regulation on protection of state secrets in the area of Ho Chi Minh City, issued together with Decision 22/2022/QD-UBND of Ho Chi Minh City, stipulating constructions of material and technical foundations for protection of state secrets in Ho Chi Minh City are as follows:
1. Heads of agencies, units and localities shall have to arrange locations and invest in building material foundations and equip them with technical means to serve the protection of state secrets of their agencies, units.
2. The management and use of funds and facilities in service of the protection of state secrets shall comply with the provisions of law.
3. Technical equipment and means in service of the protection of state secrets of agencies, units and localities must be inspected by the City Police for information security and safety, specifically as follows:
a) Conduct security checks on equipment, system software, application software, including new equipment and software used for drafting and storing documents containing state secret contents; equipment and software are upgraded or modified or supplemented before being put into use at important and secret parts and positions, or places containing state secrets belonging to agencies, units and localities. Equipment and software used for important and confidential parts and positions, which contain state secrets, or donated or sponsored or donated by foreign organizations and individuals, must be inspected by the City Police before use;
b) Repair of computers, external memory devices, electronic means with information storage function used in the protection of state secrets, if damaged, it must be done by the information technology officer of the agency, unit or locality. If outsourcing services, must be closely monitored. Computers that store state secret documents and information must be removed for repair, sealed and managed at agencies, units and localities. Repair finished, must be checked again before use;
For external memory devices, electronic means with information storage features used in the protection of state secrets are damaged, unable to be repaired or restored, or inoperable due to lack of synchronization, obsolete without need of reuse must be preserved, handled or destroyed in accordance with the process and provisions of the law on protection of state secrets;
c) When suspecting signs of information insecurity or insecurity, agencies, units and localities shall coordinate with the City Police in organizing re-evaluation;
d) Annually, agencies, units and localities shall coordinate with the City Police in organizing information security and safety checks.

In Article 5 of the Regulation on protection of state secrets in the area of Ho Chi Minh City, issued together with Decision 22/2022/QD-UBND of Ho Chi Minh City, stipulating establishment and consolidation of the Steering Committee, divisions and assignment of officials to protect state secrets in Ho Chi Minh City as follows:
1. Establishing and consolidating the Steering Committee for the protection of state secrets of Ho Chi Minh City, in which the Leader of the City People's Committee is the Head of the Steering Committee; The leader of the City Police is the Standing Deputy Head of the Standing Committee and members are related departments, branches and units to advise and assist the City People's Committee in performing the tasks specified in Clause 3, Article 24 of the Law on Protection of State Secrets 2018.
2. Depending on the size of the organization, agencies, units and localities shall establish and strengthen the Steering Committee for the protection of state secrets or the security department of their respective levels. Particularly for the district-level Steering Committee for the protection of state secrets, leaders of the district-level People's Committees shall act as heads of the committees; The leader of the district-level Police Department is the Standing Deputy Head of the Standing Committee and members are related departments, divisions and units.
3. Agencies, units and localities are responsible for assigning full-time or part-time cadres to monitor and advise on the protection of state secrets at their offices or administrative and general units.
The assignment of officials to perform the task of protecting state secrets must be made in writing and ensure the provisions of Article 7 of Decree No. 26/2020/ND-CP dated February 28, 2020 of the Government detailing a number of articles of the Law on Protection of State Secrets.

In Article 6 of the Regulation on protection of state secrets in the area of Ho Chi Minh City, issued together with Decision 22/2022/QD-UBND of Ho Chi Minh City, stipulating commitment to protect state secrets and people working directly related to state secrets in Ho Chi Minh City as follows:
1. Persons doing work directly related to state secrets (persons assigned to perform the task of protecting state secrets, ciphers, communicating, drafting documents, monitoring, managing and keeping) state secret) must meet the following criteria:
a) Having good moral qualities, meeting political standards, having legal knowledge and expertise in protecting state secrets, strictly observing the Party's lines, guidelines and policies; the laws of the State;
b) Responsible for keeping state secrets; submit to the assignment and mobilization of agencies, units and localities and fully perform assigned responsibilities and tasks.
2. Commitments to protect state secrets are made in the following cases:
a) Persons assigned tasks or tasks directly related to state secrets;

c) The person requesting the provision or transfer of state secrets

3. The written commitment to protect state secrets shall be kept at the organizational or confidential department of the agency, unit or locality.
