What are conditions for civil service exam 2024 in Vietnam?

In Article 36 of the Law on Cadres and Civil Servants 2008, amended by Clause 20, Article 1 of the Law on Cadres and Civil Servants and the amended Law on Public Employees 2019, there are regulations on civil servant exam conditions as follows:

1. A person who meets all the following conditions, regardless of nationality, gender, social status, belief and religion, may register for civil servant recruitment:

a/ Bearing the sole nationality of Vietnamese;

b/ Reaching full 18 years of age;

c/ Filing an application for recruitment; having a clear personal record;

d/ Possessing relevant diplomas and/or certificates;

e/ Possessing political qualities and good ethics:

f/ Being physically fit for the job;

g/ Meeting other conditions required by the working position for which he/she applies.

2. The following persons may not register for civil servant recruitment:

a/ Not residing in Vietnam;

b/ Having lost civil act capacity or having such capacity restricted;

c/ Being examined for penal liability; currently serving a criminal sentence or court ruling or having completely served such a sentence or ruling but such criminal record has not yet been remitted, or sending to compulsory detoxification facilities, sent to compulsory educational establishments.

How often is civil service exam held in Vietnam? 

Article 3 of Decree 138/2020/ND-CP stipulates basis for recruitment of civil servants specifically as follows:

Basis for civil servant recruitment

1. Recruitment of civil servants must be based on task requirements, job positions and payroll quotas.

2. The agency competent to recruit civil servants develops a recruitment plan and reports it to the civil servant management agency for approval as a basis for recruitment before each recruitment period. The content of the recruitment plan includes:

a) The number of civil servant payrolls assigned by competent authorities and the number of unused payrolls of the agency employing civil servants;

b) Number of staff to be recruited for each job position;

c) Number of job positions to be recruited for ethnic minorities (if any), clearly defining the criteria and ethnic structure to be recruited;

d) Number of job positions for recruitment (if any) for each target group: People who commit to volunteering to work for 5 years or more in areas with extremely difficult socio-economic conditions; Students who study under the recruitment regime according to the provisions of the Education Law, after graduating, return to work in the locality where they are sent to study; excellent graduate students, talented young scientists;

d) Standards and conditions for applying for each job position;

e) Form and content of entrance examination or admission;

g) Other contents (if any).

3. Recruitment plan when considering admission for groups of excellent graduates and talented young scientists shall comply with Government regulations on policies to attract and create a source of staff from excellent graduates and young scientists.

Thus, the current law does not specifically stipulate the time for organizing civil service exams in Vietnam. The organization of civil servant recruitment exams depends on the task requirements, job positions and staffing quotas of each agency and unit.

When are civil servants temporarily suspended from work?

Article 81 of the Law on Cadres and Civil Servants 2008 stipulates suspension of cadres and civil servants from working as follows:

Suspension of cadres and civil servants from working

1. While considering disciplining a cadre or civil servant, the agency, organization or unit managing him/her may issue a decision to suspend his/her work if il deems that his/her continued work may cause difficulties to the handling of his/her violation. The time limit for such suspension is 15 days and may be extended in special cases but not for another 15 days. If a cadre or civil servant is seized or detained to serve investigation, prosecution or trial activities, the period of seizure or detention is regarded as a time of justified leave; past this time limit if the cadre or civil servant faces no discipline, he/she may resume his/her work.

2. During the time of work suspension or seizure or detention to serve investigation, prosecution or trial activities, a cadre or civil servant may still receive salaries under the (iovernment’s regulations.

Thus, a civil servant is suspended from work during the period of considering and disciplining officials and civil servants. If that official or civil servant is allowed to continue working, it mmay cause difficulties in review and handling.
