What are cases of declassification of State secrets in the fields of planning, investment and statistics in Vietnam?

Pursuant to Clause 2 and 3, Article 12 of the Circular 07/2020/TT-BKHĐT stipulating cases of declassification of State secrets in the fields of planning, investment and statistics in Vietnam as follows:

2. State secrets are automatically declassified in the following cases:

a) At the end of the protection period, the extension of the time limit for protection of state secrets specified in Articles 19 and 20 of the Law on Protection of State Secrets.

b) No longer on the list of state secrets. In this case, the agency or unit that determines the state secret must stamp or issue a document or other form confirming the declassification and notify the date in writing to the relevant agency, organization or individual.

3. State secrets shall be declassified in whole or in part in cases where they need to be declassified to meet practical requirements for protection of national interests, ethnic groups, socio-economic development, national defense and security, international integration and cooperation. In this case, agencies and units must conduct declassification according to the following order and procedures:

a) The heads of agencies and units in the planning, investment and statistics industry that identify state secrets shall establish a declassification council.

b) The declassification council consists of representatives of leaders of agencies and units determining state secrets as the Chairman of the Council and representatives of relevant agencies and units.

c) The Declassification Council is responsible for reviewing the declassification, and reporting to the heads of agencies and units in the planning, investment and statistical sectors identifying state secrets to issue a decision on declassification.

d) In case of partial declassification, the declassified contents shall be included in the declassification decision and within 15 days from the date of issuance of the declassification decision, the declassified agency or unit shall have to notify in writing relevant agencies, organizations and individuals to seal the declassification or issue a document confirming the declassification of documents and containers containing state secrets under their management.

dd) In case of declassification of all state secrets, after the decision on declassification, it must be stamped with declassification stamp or have a written confirmation of the declassification and within 15 days from the date of decision to declassify state secrets, the agency or unit conducting declassification shall notify in writing relevant agencies, organizations and individuals to stamp declassification or have a document identifying the declassification of documents and containers containing state secrets under their management.

e) The declassified file must be archived, including the decision on the establishment of the Declassification Council; state secrets proposed to be declassified; meeting minutes of the declassification council; declassification decisions and other relevant documents.

How to declassify and seal samples of state secrets in the field of planning, investment and statistics in Vietnam?

Pursuant to Clause 1, Article 12 of the Circular 07/2020/TT-BKHĐT, the declassification of a state secret is the removal of the secrecy of a state secret.

Pursuant to Clause 4, Article 12 of the Circular 07/2020/TT-BKHĐT and Circular 24/2020/TT-BCA stipulating the declassified seal sample as follows:

Pattern of "DECLASSIFIED" seal: Rectangular, size 30mm x 13mm, with two surrounding contours, the distance between the two contours is 01mm; the first row is the words “DECLASSIFIED” presented in capital letters, font size 14, font times new roman, vertical, bold; the second row is the word "From: ..." where the row and the dots to the end, presented in lowercase, font size 13, font times new roman; The distance between the first line and the second line is 02 mm. After stamping “Decrypted” in the line “From:….” must clearly state the time for declassification starting from the date, month and year of the competent leader signing the decision on declassification.

The "DECLASSIFIED" stamp is used to stamp on state secret documents from the date on which the decision on declassification of the competent person is issued and from the date on which the notice of declassification is received or in the case specified at point c, Clause 2, Article 22 of the Law on Protection of State Secrets.
