What are the disciplinary actions against communist party members involving illegal management, issuance, and use of diplomas and certificates in Vietnam?

According to Article 21 of Regulation 181-QD/TW of 2013 issued by the Central Committee of the Communist Party of Vietnam on disciplinary actions against communist party members who commit violations against the legal regulations:

1. Communist party members who commit one of the following violations causing minor consequences shall be disciplined in the form of a reprimand:

a) Receiving and using illegal diplomas, certificates, and certifications.

b) Notarizing, certifying, and confirming diplomas, certificates, and certifications in violation of legal regulations.

c) Failing to fulfill or incorrectly fulfilling the responsibilities of issuing, certifying copies, or confirming the legality of issued diplomas, certificates, and certifications.

d) Failing to establish or inadequately establishing records as required for the issuance and management of diplomas, certificates, and certifications.

đ) Inaccurately declaring diplomas, certificates, and certifications.

e) Being responsible for managing diploma and certificate templates but negligently allowing others to misuse them to create fake diplomas and certificates.

g) Failing to direct the inspection, review, and handling of cadres, communist party members, officials, and public employees who violate the decision to issue, confirm, notarize, or purchase illegal diplomas, certificates, and certifications under their authority.

2. In cases where disciplinary action as stipulated in Clause 1 of this Article has already been taken, but there is a repeat offense or the first violation causes serious consequences, or one of the following violations is committed, disciplinary measures, including a warning or dismissal (if holding a position), shall apply:

a) Seeking, purchasing, and using illegal diplomas, certificates, and certifications to create profiles for examinations, selections, advanced studies in culture, theories, professional exams, rank transitions, promotions for appointment, election, awards, or recognition of titles from the Communist Party and the State.

b) Negligence causing loss or damage to the record content they are responsible for managing for the issuance of diplomas, certificates, and certifications.

c) Interfering with individuals or organizations to ensure oneself or others are confirmed or issued illegal diplomas, certificates, and certifications which are inappropriate for the beneficiaries.

d) Signing and issuing illegal diplomas and certificates to individuals who do not meet standards and conditions, or making decisions or proposing to competent authorities to issue illegal diplomas, certificates, and certifications.

đ) Forging, intentionally amending, supplementing, or falsely confirming documents to mislead the issuing authority into issuing diplomas, certificates, and certifications to unqualified individuals; amending, supplementing incorrect information on diplomas and certificates for unlawful purposes.

3. Violations stipulated in Clause 1 and Clause 2 of this Article causing very serious consequences or committing one of the following violations shall be disciplined by expulsion from the Communist Party of Vietnam:

a) Engaging in recruitment, selection, and training but intentionally allowing unqualified individuals to use illegal diplomas, certificates, and certifications to participate in examinations, selections, and advanced studies.

b) Exploiting position and authority to cover for officials, communist party members under their management using illegal diplomas, certificates, and certifications.

c) Directly participating in or abetting the production, distribution, or brokerage of distributing diploma templates, certificate templates, or illegal diplomas, certificates, and certifications.
