Vietnam: Procedures for taking disciplinary action against communist party members giving a third child
The disciplinary measures against communist party members giving a third child in Vietnam are stipulated in Article 27, Regulation 102-QD/TW of 2017 as follows:
1- Communist party members who violate any of the following cases causing minor consequences or give a third child (except when otherwise prescribed by law) shall be disciplined in the form of a reprimand:
a) Impeding or forcing the implementation of family planning; participating in diagnostic activities to determine the gender of the fetus contrary to regulations.
b) Falsely declaring or requesting dishonest confirmation or assessment about the health status of the spouse (husband or wife), or child to improperly implement or evade being sanctioned for violating population and family planning policies.
2- In cases where the violation has been disciplined according to the provisions in Clause 1 of this Article and recurred or caused serious consequences in the first occurrence, or violated in case of having a fourth child (except when otherwise prescribed by law), communist party members shall be disciplined in the form of a warning or dismiss (if holding a position).
3- In cases where the violation stipulated in Clauses 1 and 2 of this Article causes very serious consequences, or communist party members give a fifth child or more, or commit the following violations, communist party members shall be disciplined in the form of expulsion:
Deception in giving birth or adopting which is essentially giving birth to intentionally have more children outside the regulations.

Thus, in this case, the communist party member who is a leader (Secretary of the CPV Committee, Chairman of the Board of Directors) gives a third child. However, this comrade voluntarily reported to the CPVE cell during the regular meeting in April 2016, and this action did not cause any serious consequences at all. Therefore, the Secretary of the CPV Committee is only subject to disciplinary action for communist party members violating population and family planning policies, in accordance with Article 27, Regulation 102-QD/TW of 2017, in the form of a reprimand.
