Vietnam: Can commune-level officers who have 5 years of service without a university degree be transferred to the position of an official?
According to Article 18 of Decree 138/2020/ND-CP on accepted as Vietnamese official:
Regarding the persons to be accepted:
a) Employees working at public service providers;
b) Commune-level officers and officials;
c) Individuals receiving salaries in the armed forces, and those working in cipher organizations other than officials.

Based on the requirements of the job position to be recruited, the head of the managing agency shall review and accept the cases specified in Clause 1 of this Article if they meet the eligibility criteria for official recruitment registration stipulated in Clause 1, Article 36 of the Law on Vietnamese officials. They must not be under disciplinary action, and must not be within the timeframe for executing disciplinary actions as prescribed in Article 82 of the Law on Officials, as amended and supplemented by Clause 17, Article 1 of the Law on Amendments to the Law on Vietnamese officials and the Law on Public Employees, in addition to the following standards and conditions:
Cases specified in Points a, b, and c of Clause 1 of this Article must have at least 05 years of working experience (excluding probation or internship periods; if there is a break in service, the time may be accumulated, including any prior working periods in positions under Points a, b, c, and d of Clause 1 of this Article) engaging in jobs requiring professional training qualifications suitable for the position to be recruited.
Therefore, to be accepted as an official, you must have at least 05 years of work in jobs requiring professional training qualifications suitable for the position to be recruited. This period excludes probation or internship times.
