Understanding the Curfew Order
Based on Article 22 of the 2018 National Defense Law, the Curfew is regulated as follows:
Curfew is a measure that prohibits or restricts the movement and activities of people and vehicles during certain hours in particular areas, except as permitted by the authority organizing the implementation of the curfew order.
A curfew order is issued in cases where the political security, order, and social safety situation in one or several localities becomes complicated, threatening to cause serious instability, and is continuously announced on public media.
The authority to issue a curfew order is specified as follows:
a) The Prime Minister of the Government of Vietnam issues a curfew order in one or several provincial-level localities;
b) The provincial-level People's Committee issues a curfew order in one or several district-level localities;
c) The district-level People's Committee issues a curfew order in one or several commune-level localities;
d) The People's Committee of the special administrative-economic unit issues a curfew order in one or several areas within its jurisdiction.
- A curfew order must define the following contents:
a) Curfew area;
b) The unit responsible for and the tasks for implementing the curfew order;
c) The start and end time of the order, not exceeding 24 hours; upon the expiry of the order, if a continuation is necessary, a new order must be issued;
d) The tasks and powers of agencies, organizations, and individuals in the curfew area;
e) Necessary social order regulations in the curfew area.
- Measures applied during the curfew period include:
a) Prohibiting gatherings of large numbers of people;
b) Prohibiting people and vehicles from moving or operating during certain hours in particular areas;
c) Suspending or restricting activities at certain public places at specific times;
d) Setting up guard and control stations, inspecting items, luggage, vehicles, and documents of people moving through the guard and control stations;
e) Timely detaining and handling individuals and vehicles violating the curfew order and other legal provisions.
- The Government of Vietnam stipulates the procedure for issuing a curfew order; the responsibilities and powers of agencies, organizations, units, and localities in implementing the curfew order.
