Position and Function of the Department of Health
According to Article 1 of Circular 37/2021/TT-BYT stipulating the position and function of the Department of Health as follows:
The Department of Health is a specialized agency under the Provincial People's Committee, with the function of advising and assisting the Provincial People's Committee in state management of health, including the fields of: preventive medicine; medical examination and treatment; rehabilitation; medical forensic examination, forensics, psychiatric forensics; traditional medicine and pharmacy; reproductive health; medical equipment; pharmaceuticals; cosmetics; food safety; health insurance; population; and public services in the health sector as prescribed by law.
The Department of Health has legal status, its own seal, and separate accounts; is under the direction and management regarding organization, staffing, and operations of the Provincial People's Committee; and is concurrently under the direction, guidance, inspection, and professional supervision of the Ministry of Health.
Position and Function of the Health Office
According to Article 3 of this Circular, the position and function of the Health Office:
The Health Office is a specialized agency under the District People's Committee, with the function of advising and assisting the District People's Committee in state management of health, including: preventive medicine; medical examination and treatment; rehabilitation; traditional medicine and pharmacy; reproductive health; population; medical equipment; pharmaceuticals; cosmetics; food safety; and health insurance within the district.
The Health Office is under the direction and management regarding organization, staffing, and operations of the District People's Committee, and is concurrently under the direction, guidance, inspection, and professional supervision of the Department of Health.
For districts where a separate Health Office is not organized, the function of advising and assisting the District People's Committee in state management of health is carried out by the Office of the People's Council and the District People's Committee.
